ViewPoint Cloud Permit# CDOA-20-34
Request for Determination of Applicability, 39 Turning Mill Road
Applicant: Barbara Buchmann for Peter Von Thuna
Property Owner: Peter Von Thuna
Project: Abandonment of existing septic system, and the construction of a sewer extension
between the existing home and the existing stub located within Turning Mill Road. Portions
of the work proposed are within one hundred feet of jurisdictional wetlands, to the east of the
work area.
Documentation Submitted:
— "Site Plan, 39 Turning Mill Road"; Sheet No 1 of l; Prepared for: Barbara Buchmann;
Prepared, stamped and signed by: Frederick W. Russell, PE Civil No. 36713; Scale:
1"=20' and not to scale; Dated 12/16/2020
— "Description of Work"; Uploaded by Mary Trudeau Hill on 12/18/2020;
— "WPA Form 1-Request for Determination of Applicability" application; Prepared for:
Barbara Buchmann; Prepared by: Mary Trudeau Hill; Signed 12/18/2020;
— "USGS Locus for 39 Turning Mill Road, Lexington, MA"; dated 12/17/2020;
— "National Flood Hazard Layer FIRMette"; Provided by: FEMA; Scale: 1:6,000; Dated
12/17/2020;
— "39 Turning Mill Road, Lexington, MA: NHESP and DEP Wetland Mapping"; dated
12/17/2020;
— Memo from Mary Trudeau, Wetlands Consultant, to Peter Von Thuna, Property Owner;
RE: "39 Turning Mill Road, Lexington, MA Wetlands Delineation"; Dated 11/30/2020;
Ms. Mary Trudeau, Wetland Scientist representing the applicant, Mr. Peter Von Thuna,
presented before the Commission. Mr. Von Thuna would like to sell his property and in order to
do this will need to either fix his failed Title V septic system or connect to sewer. The current
system is non-functioning; however, no one is residing in the home. Portions of the home fall
within the 50 to 100 foot buffer zone and the home will act as an erosion control barrier for much
of the work. The sewer line is a 6-inch gravity fed line and will range between 4 to 6 feet below
the surface at about a 2% grade. The timeline for the project is estimated to be 1 to 3 weeks,
depending on material availability and the time of year.
Mr. Langseth asked if grass will be replaced when filling in the trench. Ms. Trudeau responded
that the applicant will be replacing in-kind with rhododendrons and that most of the property is
not currently grassy.
Ms. Samuels asked how the patio will act as an erosion control and Ms. Trudeau responded that
the patio is a step up so it will act as a barrier.
On a motion by Ms. Ladd and seconded by Ms. Samuels, the Commission voted 7-0 by roll call
vote to issue a negative determination with conditions.
Record of vote as follows:
Duke Bitsko —Aye
Kevin Beuttell—Aye
