<br /> <br /> <br /> <br /> <br /> <br />Upper Crust Pizzeria – Update <br /> <br />Ms. McCartin gave a brief overview informing the Board that Upper Crust had conducted <br />training with their Food Safety consultant Walter Solorzano and the staff members. The <br />consultant will continue doing routine inspections for the next several months and provide <br />updated inspection reports to the Health Office. The staff will perform an inspection before the <br />next Board of Health meeting and report on progress. <br /> <br />Semi-Public Pool Variance Request: <br /> <br /> Ms. Wolf- Fordham made a motion to grant the variances of the following Pool facilities’ that <br />requested to have No Lifeguard present Article XVI Bathing Places 155-116. <br /> <br /> Aloft Pool <br /> Element Pool <br /> Brookhaven Pool <br /> Waterstone Pools <br />Dr. Tung seconded the motion. The motion passed unanimously. <br /> <br />Dr. Tung made a motion stating “The Lexington Board of Health grants the variance request <br />from the requirement of lifeguards for the safe operation of pools as listed under Article XVI, <br />Bathing Places § 155-116. In addition, all requirements of 105 CMR 435.23 (2) shall be met <br />including all signage which includes: “Warning No Lifeguard on Duty” in easy to read, legible <br />letters which are at least four inches high “Children under age 16 should not use swimming pool <br />without an adult in attendance” and another sign that states, “Adults should not swim alone.” <br />This variance applies only to the following seasonal pool facilities, which have made the request <br />in writing. Listed as follows: <br /> Adams Pool <br /> Five Fields Pool <br /> Peacock Farm Pool <br /> Moon Hill Pool <br /> Pleasant Brook Pool <br /> <br />This Variance will expire at the end of the Seasonal Pool season, pool expiration date, or upon <br />notification of an unsafe operating condition at a specific facility.” The Motion was seconded by <br />Ms. Wolf-Fordham. The motion passed unanimously. <br /> <br />Dr. Tung made a motion stating “The Lexington Board of Health grants the variance request <br />from Swimming Pool Code 105 CMR 435.23 (1), to allow two lifeguards to work at the Pleasant <br />Brook pool who are not 16 years old or older.
