BOA Meeting, September 24, 2009 9 <br /> Minutes of the Lexington Zoning Board of Appeals <br /> Selectmen's Meeting Room, Lexington Town Hall <br /> September 24, 2009 <br /> Board Members Present: Chairman Nyles N. Barnert, Arthur C. Smith, John J. <br /> McWeeney, Carolyn C. Wilson and Associate Member Leo McSweeney. <br /> Staff Present: David L. George, Zoning Administrator <br /> Petition Address: 411 Waltham Street, Map 32, Lot 14. <br /> Prior to the hearing, the petition and supporting data were reviewed by the Building <br /> Commissioner, Conservation Administrator, Town Engineer, Health Director, Board of <br /> Selectmen, the Zoning Administrator, the Planning Administrator and the Historic <br /> Districts Commission Clerk. Comments were received from the Zoning Administrator <br /> and Planning Board. Comments were also received from the Design Advisory <br /> Committee. <br /> The Chairman opened the hearing at 8:00 pm by reading the legal notice and described <br /> information received from the petitioner relative to the petition. <br /> Suren Der Avedisian presented the petition. <br /> Mr. Der Avedisian stated that he sought to install 2 banner signs to the exterior of the <br /> building attached to the front overhang and to locate 2 sandwich board signs adjacent to <br /> Waltham Street. Mr. Der Avedisian described the signs. The board asked Mr. Der <br /> Avedisian why he needed the additional signage (the store had one wall sign and <br /> numerous window signs). Mr. Der Avedisian stated that the signage was needed to <br /> promote special events. The board expressed concern with setting precedent by granting a <br /> special permit for the signage. A board member felt that additional signs, in violation of <br /> the Zoning By -law, might appear throughout town. It was felt that the issue of temporary <br /> signs needed to be comprehensively reviewed by the Town. Mr. Der Avedisian stated <br /> that there were already several sandwich board signs up in town and that his uses for the <br /> proposed signs were no different than other sandwich board signs. The board wanted to <br /> know the frequency with which the signage would be displayed. Mr. Der Avedisian <br /> indicated the banner may be up 2 weeks a month and the sandwich board sign 52 weeks a <br /> year and brought into the store after the business closes. The board sought a schedule of <br /> when the signs would be displayed, if approval granted. The signage may be allowed by <br /> special permit in accordance with CH. 135 of the Code of the Town of Lexington <br /> (Zoning By -law) section 135 -78D in conjunction with section 135 -11. <br /> The applicant indicated his willingness to reduce his request to one vinyl banner and one <br /> sandwich sign. <br /> No one in the audience spoke either in favor of or in opposition to the petition. <br /> The hearing was closed at 8:19 pm. <br />
