161 <br /> ADJOURNED SESSION - 1995 ANNUAL TOWN MEETING <br /> MARCH 29, 1995 <br /> The meeting was called to order by Moderator Margery M. <br /> Battin, at 8 p.m. , in Cary Memorial Hall. <br /> A quorum was present. <br /> 8:00 p.m. The Moderator outlined procedures and <br /> protocol. <br /> ARTICLE 2 REPORTS <br /> 8:07 p.m. James Scanlon, Permanent Building Committee, <br /> moved that the report of the committee be accepted and <br /> placed on file. <br /> Following a voice vote at 8:07 p.m. , the Moderator <br /> declared the report to have been accepted and placed on <br /> file. <br /> 8:09 p.m. Jason Berger presented a verbal report for the <br /> Personnel Advisory Committee. <br /> ARTICLE 24 LAND TRANSFER <br /> 8:15 p.m. Selectman Fenn moved the following substitute <br /> motion under Article 24: <br /> A. With respect to parcel (a) described in this Adopted <br /> article, that the Conservation Commission be See p.161 <br /> authorized to purchase or otherwise acquire, and <br /> the Selectmen be authorized to take by eminent <br /> domain, upon the written request of the <br /> Conservation Commission, and that the Selectmen be <br /> authorized to transfer for conservation purposes <br /> and for recreational uses as approved by the <br /> Recreation Committee any fee, easement or <br /> conservation restriction as defined in Section 31 <br /> of Chapter 184 of the General Laws, or other <br /> interest in all or any part of such parcel. <br /> B. With respect to parcel (b) described in this <br /> Adopted <br /> article, that the Conservation Commission be <br /> See p.162 <br /> authorized to purchase or otherwise acquire, and <br /> the Selectmen be authorized to take by eminent <br /> domain, upon the written request of the <br /> Conservation Commission, and that the Selectmen be <br /> authorized to transfer for conservation purposes <br /> and for recreational uses as approved by the <br /> Recreation Committee any fee, easement or <br /> conservation restriction as defined in Section 31 <br /> of Chapter 184 of the General Laws, or other <br /> interest in all or any part of such parcel. <br /> C. With respect to parcel (c) described in this Adopted <br /> article, (i) 'that the care, custody, management, See p.163 <br /> and control of such parcel no longer needed by the <br /> School Department be transferred to the Board of <br /> Selectmen for conservation and recreation purposes, <br /> and (ii) that the Conservation Commission be <br /> authorized to purchase or otherwise acquire, and <br /> the Selectmen be authorized to take by eminent <br /> domain, upon the written request of the <br /> Conservation Commisbion, and that. the SeieeLm-L <br /> authorized to transfer for conservation purposes <br /> and for recreational uses as approved by the <br /> Recreation Committee any fee, easement or <br /> conservation restriction as defined in Section 31 <br /> of Chapter 184 of the General Laws, or other <br /> interest in all or any part of such parcel, except <br /> that the Selectmen shall retain under their <br /> jurisdiction the area delineated on the plan filed <br /> with the Town Clerk. <br />
