All subject to the existing conditions established by the Board of Appeals on previous petitions of Lexington Indoor Tennis Club Corp. and/or The Middlesex Tennis & Swim Club and/or Thomas R. Aldrich, Jr. Spring Street Trust - withdrawn. Rodney W. Poling, D.V.M. - pursuant to Section 12.3, a variance from Section 25.69 to erect and maintain a building to be used as a hospital for the prac- tice of veterinary medicine adjoining the dwelling at 519 Lowell Street which is to be used for his residence and for a variance of Section 27 to maintain an existing dwelling at 519 Lowell Street which has a front yard setback on Lowell Street of approximately 20 ft. instead of the required 30 ft. and a side yard of approximately 7 ft. instead of the required 15 ft. and for per- mission to subdivide the premises at 519 Lowell Street in such a manner so as to create two legal building lots, one of which will have an area of 19,200 square feet more or less instead of the required 30,000 square feet 6f land. William H. Hamilton and Marilyn H. Hamilton, Trustees of Volunteer Associates Realty Trust - variance to permit the construction of a single family dwell- ing on a lot of land shown as Parcel "B" on Plan Filed, which has sufficient area of 5 acres, more or less, with insufficient frontage on Concord Avenue, Lexington. Said parcel of land is located between the dwellings at 303 and 311 Concord Avenue and extends to the rear of the property at said 311 Concord Avenue. Following the hearings the Board made the following decisions, all in public open meeting: Tennis Club - granted unanimously. Spring Street Trust - withdrawn. Rodney W. Poling, D.V.M. - denied unanimously. Hamilton - granted unanimously, subject to the condition that a driveway to the back land of Parcel "B" over the 50 ft. passageway shall not come closer than 25 feet of the land of the abutters, Joseph L. and Marion C. Hyatt. A vote to appeal the "turned -over" decision by the Department of Community Affairs on the St. Brigid's low and moderate income housing (Planning Office for Urban Affairs) passed 4 to 0. (Mr. Taylor,abstaining) Copies of the decisions made in regard to hearings are on file in the Board of Appeals' office. Originals are filed with the Town Clerk.
