BOARD OF APPEALS HEARINGS <br />May 8, 1973 <br />A regular meeting of the Lexington Board of Appeals was held on Tuesday, <br />May 8, 1973 at 7:30 p.m. in the Selectmen's Meeting Room of the Town Office <br />Building. Present were Chairman Nickerson, regular members, G. Sheldon, R. <br />Morey and G. Wadsworth, and associate member H. Reed. An audience of inter- <br />ested townspeople were also present, as well as, a reporter from the Lexing- <br />ton Minute -man Publications. <br />Public hearings were held on the following petitions, notice having been <br />mailed to the petitioners, to the owners of all property deemed by the Board <br />to be affected thereby as they appear on the most recent local tax list, to <br />town boards and officials who will or might be affected by decisions made, <br />and also advertised in the Lexington Minute -man. <br />Mary -Brenda Cortell - variance of the Lexington zoning by-law under section <br />27 in order to build an addition to the existing dwelling at 12 Partridge <br />Road, which will leave a 14 ft. 3 in. side yard instead of the required 15 <br />ft. side yard. <br />Mildred E. Whitney - renewal of the special permit approving as an accessory <br />use, in accordance with section 25.81 of the zoning by-law of the town of <br />Lexington, as amended to September 15, 1972, the use of a portion of her <br />residence located at 1415 Massachusetts Avenue for the operation of a profes- <br />sional secretarial service, incidental to her residence. <br />Hayg and Brigitte Boyad_jian - variance to maintain the existing dwelling with <br />a 15 ft. front yard instead of 30 ft. and the garage with no frontage at 43 <br />Fern Street and to build an addition to the existing dwelling which will leave <br />a side yard of 10 ft. instead of 15 ft. and a front yard of 13 ft. instead of <br />30 ft. The addition will have a basement, bedroom and two bathrooms. Also, <br />the dining area will be enlarged. Changes will be made in the existing porch <br />and stairway. <br />Lexington Investment & Development Corporation, John M. Hamilton & Craig A. <br />Foster - finding and determination that the proposed location of building, <br />the proposed major topographical changes, if any, and the planned provisions <br />for waste disposal, surface and ground water drainage, erosion control, park- <br />ing areas, loading areas, maneuvering areas,driveways, and the location of <br />intersections of driveways and streets are such that the proposed construction <br />of a new building will constitute a suitable development and will not result <br />in substantial detriment to the neighborhood. Said parcel of land is located <br />at 4 Militia Drive. Petitioners also request a variance of the minimum park- <br />ing requirements under sections 31 and 32 to permit the construction of a <br />lesser number of parking spaces all as shown on plans. The building to be <br />constructed is to be used for office purposes, that is, offices for adminis- <br />trative, executive, professional and similar purposes. <br />Following the hearings the Board made the following decisions, all in <br />open meeting: <br />Mary -Brenda Cortell - granted unanimously, subject to certain conditions. <br />
