r <br />BOARD OF APPEALS HEARINGS <br />' March 20, 1973 <br />A regular meeting of the Lexington Board of Appeals was held on Tuesday, <br />March 20, 1973 at 7:30 p.m. in the selectmen's meeting room of the Town Office <br />Building. Present were Chairman Nickerson, regular members Mr. Sheldon and <br />Mrs. Morey and associate members Mr. Mabee and Mr. Reed. <br />Public hearings were held on the following petitions, notice having been <br />mailed to the petitioners, to the owners of all property deemed by the Board <br />to be affected thereby as they appear on the most recent local tax list, to <br />town boards and officials who will or might be affected by decisions made, and <br />also advertised in the Lexington Minute -man: <br />James B. Catalano - permission to continue operations of retail business of <br />selling flowers, produce and plants grown on the premises at 643 Waltham Street. <br />Waltham American Trust, c/o Cabot, Cabot & Forbes Company - finding and deter- <br />mination that the construction of additional parking for 118 cars on the 8 <br />acre lot at 45 Hartwell Avenue, located as shown on site plan submitted to <br />the Board of Appeals, will constitute a suitable development and will not re- <br />sult in substantial detriment to the neighborhood in accordance with section <br />13 of the zoning by-law. <br />Robert A. Marasca - variance from the zoning by-law in order to build a garage <br />(20 ft. by 24 ft.) on the property at 240 Woburn Street. The proposed garage <br />would leave a sideyard of five (5) ft. instead of the required fifteen (15) <br />ft. The reason for the proposed location of the garage is to avoid the neces- <br />sity of cutting down a 40 ft. tree. <br />Alden L. and Judith A. Webster - to vary the zoning by-law so as to maintain <br />the existing non -conforming dwelling with its easterly side yard of 8.80 ft. <br />to 9.26 ft. and front yard of 15 ft. on the property known as 113 North Street <br />and to construct a proposed extension of said dwelling continuing the noncon- <br />forming easterly side yard ranging from 8.42 ft. to 9.26 ft. reduced by the <br />proposed roof overhang of up to 1.5 ft., all as shown on the plans submitted. <br />Lawrence G. Trebino, Trustee of Trinda Realty Trust - variance to maintain the <br />existing building located at 33 Blake Road, having a front yard setback of <br />nineteen (19) ft. instead of the required thirty (30) ft., a side street set- <br />back of seventeen (17) ft. instead of the required twenty (20) ft. and a side <br />yard setback of fourteen (14) ft. instead of the required fifteen (15) ft., <br />all as shown on the plot plan prepared by Miller & Nylander dated February 9, <br />1973. <br />The 115 Rendall Corporation - site plan review and approval for a special <br />permit pursuant to section 13 and related subsections of the zoning by-law <br />of the town of Lexington, and to make a finding and determination that the <br />proposed placement of buildings, major topographic changes, provisions for <br />waste disposal, surface and ground water drainage, erosion control, parking <br />areas, loading areas, maneuvering areas, driveways, and the location of inter- <br />sections of driveways and streets will constitute a suitable development and <br />will not result in substantial detriment to the neighborhood. The proposed <br />use of the addition to the building numbered 29 Hartwell Avenue is office and <br />
