BOARD OF APPEALS HEARINGS <br />December 7, 1971 <br />A regular meeting of the Lexington Board of Appeals was held on <br />Tuesday, December 7, 1971 at 7:30 p.m. in the selectmen's meeting room <br />of the Town Office building. Present were Chairman Nickerson, regular <br />members Abbott, Dawes, Sheldon and Wadsworth. <br />Public hearings were held on the following petitions, notice <br />having been mailed to the petitioners and to the owners of all property <br />deemed by the Board to be affected thereby as they appear on the most <br />recent local tax list and also advertised in the Lexington Minute -man: <br />Charles D. and Joan C. Killilea - to vary the Lexington Zoning By - <br />Law in order to maintain the existing dwelling and carport located at <br />18 Skyview Road with an insufficient side yard of five feet on the <br />westerly side of the property instead of the required ten feet. <br />s Minute Man Oxygen and Hospital Rental Co., Inc. - permission in <br />1 the business of dealing in medical, hospital and nursing home machinery <br />and equipment and supplies on the premises located at 240 Bedford Street <br />which it intends to occupy under a lease. <br />Joseph W. Theriault, Jr. - to vary the Zoning By -Law to build two <br />' additions to his dwelling at 4 Milk Street, one of which would have a <br />side yard of only 10' instead of the required 12 ft. and to maintain <br />the present dwelling with a side yard of 10 ft. instead of 12 ft. <br />Ruth S. Weiss - for a special permit under Section 25.81 of the <br />Zoning By -Law to use a part of the residence at 28 Barberry Road as <br />an office for the practice of medicine. The practice would be limited <br />to child psychiatry. <br />Mobil Oil Corporation - for a special permit at the parcel of land <br />now numbered 396 Waltham Street, 400 Waltham Street, and 308-318 Marrett <br />Road, now owned by Mobil Oil Corporation, Morris Bloomberg and Finest <br />Cleansers, Inc., for the demolition of the existing buildings and the <br />erection and operation of a new gasoline service station pursuant to <br />Section 25.50 of the Zoning By -Law. Mobil Oil Corporation is the owner <br />of the parcel located at 396 Waltham Street, also identified as 318 <br />Marrett Road; Mobil Oil Corporation has entered an agreement to purchase <br />the property at 310-316 Marrett Road, now owned by Finest Cleansers, Inc <br />Mobil Oil Corporation has entered an agreement to lease the property at <br />400 Waltham Street, also identified as 308 Marrett Road, now owned by <br />Morris Bloomberg. The entire parcel is located within a CG District and <br />is more particularly described in Section 23.77 of the Zoning By -Law. <br />Following the hearings the Board made the following decisions in <br />open meeting. All decisions were unanimous. <br />Charles D. and Joan C. Killilea - granted. <br />Minute Man Oxygen and Hospital Rental Co., Inc. - granted. <br />
