:367 BOARD OF HEALTH MEETING APRIL 12, 1983 The regular meeting of the Board of Health was held on Monday, April 12, 1983 at 7:15 p.m. in the Board of Health Office. Members present were: Mr. James W. Lambie, Chairman; Dr. Michael S. Erdos, Linda Roemer, Ph.D. and George A. Smith, Director of Public Health. Mr. Smith told the Board that the "No Smoking" by-law that requires res- NON-SMOKING taurants to set aside 1/4 of their seats for non-smokers. It does not BY -LAWS become a by-law until tow meeting is finished then the town clerk has 30 days to file it with the Attorney General's Office. Mr. Smith said it won't probably be put into effect until October or Novenber by the time the Attorney General sends it back. Mr. Smith said a place like Brigham's cannot comply the way the restaurant is set up so the manager is now working with Brigham's to come to a reasonable solution. The social clubs and the Sheraton -Lexington lounges (they don't serve food) would be excluded from the By-law. Mr. Smith said that some restaurants have logistic problems and some restaurants will find it difficult to abide by the new smoking (non-smoking) by-laws and will have some problems. Mr. Smith said that places like Mario's and Chadwick's will find it is difficult to set up non-smoking areas. Mr. Smith told the Board that Lisa Fitzgerald wants the animal permit in her name instead of her mother's. The Board was in agreement for George to LISA write to Lisa stating the Board wants documentation that her mother has FITZGERALD leased the land to her. The Board was also in agreement that she should not increase the number of horses from 3 (with 1 extra with a variance) to six. The Board did agree to the 3 horses with the one extra with a variance. There is 3.5 acres of Fitzgerald land. She borrows land from the abuttor but Mr. Johnson does object to the riding school Liza has been operating. Mr. Freeman came before the Board in regard to the property at 47 Ridge TED Road that he had purchased with the land around it. The tenants have moved FREEMAN out for over 60 days and now they want to move back in. He said the house 47 RIDGE is in deplorable condition. The people are elderly and they had rubbish and ROAD trash everywhere. Their septic system was connected to the brook. The house is really uninhabitable and should be condemned. Mr. Freeman said he had done everything that was asked of the Health Director - covered over the wells, and boarded up the house. The Scheme's could not come to the last meeting. They have been haling their lawyer, Mr. Tropeano doing business for them. Mr. Tropeano was invited to attend tonight's meeting but was unable to come. He did have a conversation with Mr. Smith and asked Mr. Smith what he would recommend. Mr. Smith said he would recommend not letting the Schena's back into the house.
