:367 <br />BOARD OF HEALTH MEETING <br />APRIL 12, 1983 <br />The regular meeting of the Board of Health was held on Monday, April 12, <br />1983 at 7:15 p.m. in the Board of Health Office. <br />Members present were: Mr. James W. Lambie, Chairman; Dr. Michael S. Erdos, <br />Linda Roemer, Ph.D. and George A. Smith, Director of Public Health. <br />Mr. Smith told the Board that the "No Smoking" by-law that requires res- NON-SMOKING <br />taurants to set aside 1/4 of their seats for non-smokers. It does not BY <br />-LAWS <br />become a by-law until tow meeting is finished then the town clerk has <br />30 days to file it with the Attorney General's Office. Mr. Smith said <br />it won't probably be put into effect until October or Novenber by the <br />time the Attorney General sends it back. <br />Mr. Smith said a place like Brigham's cannot comply the way the restaurant <br />is set up so the manager is now working with Brigham's to come to a reasonable <br />solution. <br />The social clubs and the Sheraton -Lexington lounges (they don't serve food) <br />would be excluded from the By-law. Mr. Smith said that some restaurants <br />have logistic problems and some restaurants will find it difficult to abide by <br />the new smoking (non-smoking) by-laws and will have some problems. Mr. Smith <br />said that places like Mario's and Chadwick's will find it is difficult to set <br />up non-smoking areas. <br />Mr. Smith told the Board that Lisa Fitzgerald wants the animal permit in her <br />name instead of her mother's. The Board was in agreement for George to LISA <br />write to Lisa stating the Board wants documentation that her mother has FITZGERALD <br />leased the land to her. <br />The Board was also in agreement that she should not increase the number of <br />horses from 3 (with 1 extra with a variance) to six. The Board did agree <br />to the 3 horses with the one extra with a variance. <br />There is 3.5 acres of Fitzgerald land. She borrows land from the abuttor <br />but Mr. Johnson does object to the riding school Liza has been operating. <br />Mr. Freeman came before the Board in regard to the property at 47 Ridge TED <br />Road that he had purchased with the land around it. The tenants have moved FREEMAN <br />out for over 60 days and now they want to move back in. He said the house 47 RIDGE <br />is in deplorable condition. The people are elderly and they had rubbish and ROAD <br />trash everywhere. Their septic system was connected to the brook. The house <br />is really uninhabitable and should be condemned. <br />Mr. Freeman said he had done everything that was asked of the Health Director - <br />covered over the wells, and boarded up the house. <br />The Scheme's could not come to the last meeting. They have been haling their <br />lawyer, Mr. Tropeano doing business for them. Mr. Tropeano was invited to <br />attend tonight's meeting but was unable to come. He did have a conversation <br />with Mr. Smith and asked Mr. Smith what he would recommend. Mr. Smith said <br />he would recommend not letting the Schena's back into the house. <br />
