The Boa^d instruc <br />Mr. Lurvey to write to Mahoney Brothers stating that their permit <br />to collect rubbish in Lexington will be revoked any time a viola- <br />tion is observed again. <br />Meeting adjourned at 4:45 P.M. <br />Clerk <br />BOARD OF HEALTH MEETING <br />MAY 20, 1960 <br />The regular meeting of the Board of health was held Friday, <br />May 20, 1960 at 3 P.M. in the Selectmen's Room of the Town Office <br />Building. Members present were R.L. McQuillan, Chairman, Dr. <br />William cosgrove and Health Officer Mark D. Lurvey. <br />Mr. LouisL. Green, Attorney and Mr. James A. Carrig came <br />before the Board to discuss the dump on Mr. Carrig's property <br />on Wellington Lane and houte 2. The Town and State law reads <br />that the property owner is responsible for any rubbish or de- <br />bris dumped on his property. Mr. Green stated that as Mr. <br />Carrig had posted "No Dumping” signs on this property he was not <br />in violation of the Health Department regulations. Mr. Green <br />also stated that Mr. Carrig had not permited or allowed any <br />dumping on this land and so was under no obligation to clean <br />it up. Mr. Green stated this was not a job that would take <br />$50.00 to $100.00 to clean up, but would probably cost be- <br />tween $200.00 or $300.00 dollars. Mr. Carrig said he would be <br />perfectly willing for the Town to go in and clean this dump up. <br />Mr. McQuillan said the Town cannot go onto private property <br />and clean up any nuisance. Mr. McQuillan stated Mr. Carrig <br />was bound by law to abate this nuisance. Other property <br />owners, in the past, when advised to clean up a nuisance on <br />their property have cooperated with the Health Department. <br />Mr. Green said he did not feel that he could advise Mr. <br />Carrig to clean up this dump without a court ruling. Mr. <br />Green also stated that if this case went to court and the lower <br />court ruled in favor of the Board of Health he would take <br />Cc <br />1 <br />1 <br />
