Minutes of the Community Preservation Committee <br />Wednesday, December 19, 2012, 6:30 pm <br />Parker Room <br />Town Offices Building <br />Present: <br />Committee Members: Wendy Manz, Chair; Joel Adler, Norman Cohen, Marilyn Fenollosa, <br />Vice Chair; Jeanne Krieger, Leo McSweeney, Sandra Shaw and Dick Wolk. <br />Administrative Assistant: Nathalie Rice <br />Also in attendance were David Kanter of the Capital Expenditures Committee (CEC) and Town <br />resident, Robert Pressman. <br />The meeting was called to order at 6:34 pm. by Ms. Manz. <br />1. Approval of the Minutes — A vote was taken (8 -0) to approve the minutes from the <br />meeting of December 6, 2012 as amended by Ms. Shaw. <br />2. Deeds Assessment Report — Ms. Manz asked members for final comments on the <br />2013 Needs Assessment Report in preparation for the upcoming hearing at 7:00 pm. <br />There were no member comments. <br />3. Updates on FY14 CPA Projects <br />a.) Lexington Center Pocket Park Design, $20,000 — Ms. Manz explained that <br />although Town Counsel, Kevin Batt, had deemed the project eligible for funding, <br />he had not been aware that the "pocket parks" would be located on private <br />property. The Community Preservation Coalition had told us that typically, the <br />acquisition of open space is secured with a Conservation Restriction, while the <br />creation of open space, a park in this case, might be secured with an easement or <br />some other agreement. Ms. Manz said she discussed this option with Mr. Batt, <br />who stated that the use of a contract would be more appropriate. Ms. Krieger <br />questioned whether this issue would exist without CPA funding, and noted the <br />small budget of the request. The CPC has requested further input from Mr. Batt <br />and the applicant, Economic Development Director, Melisa Tintocalis. <br />b.) ACROSS Lexington Pedestrian /Bicycle Route System There are additional <br />questions about the ACROSS Lexington project proposal. The Community <br />Preservation Coalition has advised Ms. Manz that the flyers and maps proposed <br />in the application might fall under "support" and as such might not be eligible for <br />funding. However, Town Counsel Kevin Batt suggests that the amount of <br />funding sought for this year can be applied to signs and markers, which are <br />eligible, so the project would not pose a problem in FY 14. <br />
