Presented by Erik Lund. <br /> MOTION: To amend the Zoning By-Law by striking out <br /> subparagraphs a. and b. and the words "on or after <br /> March 18, 1929 and in subparagraph c. of paragraph 2. <br /> of subsection (a) in Section 8 thereof under the caption <br /> R 1 and R 2 Districts and by inserting therein the <br /> following new paragraphs a. and b.: <br /> a. Any lot lawfully laid out and recorded by plan or <br /> deed prior to March 18, 1929, provided such lot contains <br /> an area of not less than 5,000 sq. ft. and a frontage <br /> upon the frontage street of not less than 50 feet and on <br /> the effective date of this amendment was not in common <br /> ownership with one or more contiguous vacant lots <br /> located in the same zoning district. <br /> b. Any lot lawfully laid out and recorded by plan or <br /> deed, provided such lot complied with area and frontage <br /> requirements for building lots in effect at the time of <br /> such recording and has an area of not less than 5,000 <br /> -sq. ft. and a frontage of not less than 50 ft. on a <br /> public way or a way shown on a plan approved under the <br /> Subdivision Control Law, may be granted a special permit-- <br /> by the Board of Appeals for an exception from the require- <br /> s ments of paragraph 1. of this subsection (a) as to area <br /> and frontage only, where a substantial area in the vicinity <br /> of such lot has been developed and built upon and the <br /> residences -in such area have been constructed on lots <br /> having no more area and frontage than such lot and where <br /> substantial financial hardship to -the owner of such lot <br /> would result from the requirements of greater area and <br /> frontage than generally prevail in the area. <br /> 9:47 P.
