�F <br />i <br />�1'� 1 <br />S ' S N 1'ING i <br />April 6, 1988 :. <br />i± <br />A regular meeting of the Board of Selectmen was held on Wednesday, <br />April 6. 1988, in the Selectmen's Meeting Room, Town Office Building, at <br />7:04 p.m. C hairman Eddison, Mr. Marshall, Mr. Dailey, Mrs. Smith, Mr. <br />McSweeney Mr. White, Town Manager; Mr. Cohen, Town Counsel; Mrs. Snow, <br />Executive Clerk, were present. <br />PHILIP ROAD B KiTTEMMMT RATE <br />Mr. Eddison noted that the Philip Road bettennent rate had been <br />addressed in prior discussions but not concluded. Because of time <br />constraints, he asked the residents present to limit their carirnents to <br />presentations by no more than two speakers and that the camnents be <br />brief. <br />Vicky Schwartz, who acted as spokesman, listed the concerns of <br />abuttors. She noted that the 20 --year old subdivision street had never <br />been accepted because of substandard construction although the bond had <br />been released by the Town. She said that residents had not been aware <br />of the street's status until 1984. In 198% Philip Road was laid out as <br />a Public Way, but the Warrant Article was withdrawn because of budget <br />limitations. Mrs. Schwartz referred to deterioration of the road <br />because of heavy use by School buses and felt that residents had a <br />legitimate claim to have the street constructed and accepted with a <br />token betterment. <br />One resident ccm anted that if residents had been aware that the <br />street was not acceptable, they could have brought action against the <br />developer in 1971. He said residents felt that the Town should either <br />bring the road up to standards or post it as a "Private Way ". <br />Mr. White explained the purpose and procedures involved in the <br />bonding process, adding that the Town accepts no responsibility for <br />daily inspections of road construction. He pointed out that Philip Road <br />does not meet Town standards at this time and felt that a dangerous <br />precedent would be created if no bet is were to be charged. <br />Motion was made and seconded to assess betterments of $14.3 41per <br />frontage foot (or 50% of construction cost) for construction of Philip <br />Road, <br />Mr. Dailey said he would be willing to vote for the 50% rate rather <br />than the cust 90% rate in view of circumstances, but would not <br />approve of any procedure which would make it appear that the Town is <br />responsible for the Philip Road situation. Mrs. Smith felt the <br />ctprw ase was fair since the road is used as access to the Bowman <br />School by school buses. <br />Motion having been duly made and seconded, it was voted to approve <br />a bettenrent rate of $14.34 per frontage foot for construction of Philip <br />Road. <br />HANSCOM FIELD <br />Mr. Eddison reported on his and Mr. White's March 29th visit to <br />Hanscom Field for discussion with Generals Chubb and Nelson of Air Force <br />plans for devel t at the Field. <br />
