3 4 1 <br />?MW <br />POW <br />'= A Y ril 18, 1986 <br />N <br />T <br />A regular meeting of tt/ Board of Selectmen was held on Wednesda <br />April 16, 1986, in the Selectmen's Meeting Room, Town Office Building, at <br />7:00 p.m. Chairman Marshall, Mr. Eddison, Mr. Dailey, Mrs. Smith, Mr= <br />McSweeney; Mr. Hutchinson, Town Manager; Mr. Cohen, Town Counsel; Mrs. Snow, <br />Executive Clerk, were present, <br />i SELECTMEN ' S MEETING <br />t <br />SPECIAL TOWN MEETING <br />Mrs. Miller, Chairman of the Conservation Commission, was present for <br />discussion of the Commission's request for a Special Town Meeting, within <br />the Annual Town Meeting, for the purpose of presenting a proposal for a Land <br />Bank transfer tax for Lexington. She explained the proposed home rule <br />petition would provide a method for obtaining funds for acquisition of land <br />in the Commission's Master Plan by assessing either buyers or sellers of <br />property up to 1% of the selling price of property being transferred with a <br />$100,000 exemption for first -time buyers.' This was estimated to amount to <br />revenues of $500,000 - $1,000,000 yearly. <br />Mr. Eddison, who supported the concept in principle, said that because <br />of a number of questions still unresolved, he was in favor of tabling the <br />request or voting against it at this time. <br />Mr. Cohen noted the time and expense aspects involved and expressed <br />doubt that the Legislature would pass each such request from Lexington and <br />other towns. He recommended requesting favorable votes on the bill by <br />Senator Kraus and Representative Doran. <br />Mr. Marshall felt that timing would be poor with respect to the <br />Selectmen's focus on financial articles to be considered and would add as <br />element of confusion. <br />Mr. Hutchinson referenced a statement by Mr. Segal, Mass. Municipal <br />Association, that it was highly unlikely that Lexington would get a bill for <br />itself. <br />Upon motion duly made and seconded, it was voted, without prejudice, <br />not to support at this time the request of the Conservation Commission that <br />a Special Town Meeting be called within the Annual Town Meeting, <br />SBLECTNEN`S MINtlTES <br />Mr. Marshall read a letter dated April 16, 1986, from Elizabeth Banks <br />of the Lexington Minute -Man, requesting copies of minutes of the Board's <br />open meeting on April 9th, and of sections of minutes of the Executive <br />Session on that date which pertain to any action taken relative to Lexington <br />Dews construction. <br />Mr. Cohen reported that, based on a recent opinion by the District <br />Attorney, open session minutes even though unapproved and not in final form, <br />should be provided, according to Attorney Fabbri of the D. A.'s Office, but <br />that Executive Session minutes are not considered to be public record until <br />released by the Board after determination that their publication would not <br />defeat the reason for holding the executive sessions <br />
