ARTICLE 16 AMEND NOISE BY-LAW (Citizens' Petition) <br /> To see if the Town will vote to amend the current Lexington Noise By-Law Section 80-8 Special <br /> Permits by inserting a new Section E <br /> Section E Any Special Permit issued under Section 80-8 shall be reviewed and shall be <br /> subject to either. 1)the imposition of additional conditions which shall reasonably alleviate <br /> the violation, or, 2) revocation of said Permit if it is determined that additional conditions <br /> would fail in alleviating the violation, if the Board of Selectmen receives new evidence <br /> determinative of the fact that noise at the boundary of the property in which the offending <br /> sound source is located exceeds permissible limits as determined by this By-law, <br /> Commonwealth statutory regulation, or Federal law, or act in any other manner in relation <br /> thereto <br /> (Inserted by Bnan Susnock and nine or more registered voters) <br /> DESCRIPTION The existing Lexington Noise By-law, a relatively new law, provides that <br /> under certain circumstances a Special Permit can be issued for any activity otherwise <br /> forbidden by the provisions of the by-law Based on the fact that conditions may change or <br /> new information may be discovered, this article proposes to refine the Noise By-law by <br /> adding a provision that special permits are subject to review by the Board of Selectmen. <br /> FINANCIAL ARTICLES <br /> ARTICLE 17 APPROPRIATE FY2007 OPERATING BUDGET <br /> To see if the Town will vote to make appropriations for expenditures by departments, officers, <br /> boards and committees of the Town for the ensuing fiscal year and determine whether the money <br /> shall be provided by the tax levy or by transfer from available funds, including any revolving or <br /> special funds, including enterprise funds, or by any combination of these methods, or act in any <br /> other manner in relation thereto <br /> (Inserted by the Board of Selectmen) <br /> DESCRIPTION This article requests funds for the FY2007 (July 1, 2006—June 30, 2007) <br /> operating budget. The operating budget includes the school and municipal budgets The <br /> operating budget also includes requests for funds to provide salary increases for employees, <br /> including salaries negotiated through collective bargaining negotiations The budget also <br /> includes certain shared costs These are primarily the costs of debt service requirements, <br /> property and liability insurance on school buildings and contents, health insurance and <br /> pension costs for school employees other than professional staff Appendix A lists by <br /> account FY2005 expenditures, FY2006 appropriations and FY2007 proposed <br /> appropriations Please note that figures for FY2005 and FY2006 have been restated to <br /> reflect the revised FY2007 presentation. <br /> 14 <br />
