(Adj.. Tn. Mtg. - March 25, 1975) <br /> Article 70. Presented by Eric T. Clarke. <br /> MOTION: That the Zoning By -Law of the Town be amended by adding a <br /> * (See new subsection 24.7 as set forth in this article. <br /> below. 8:15 P. M. <br /> Article (Article as set forth in the warrant: <br /> as <br /> amended ARTICLE 70. To see if the Town will vote to amend the Zoning By -Law <br /> .Approved by .inserting a new subsection 24.8 as follows: <br /> by the <br /> Atty. Gen., "Every swimming pool shall be completely surrounded by a fence or wall <br /> June 9, not less than four (4) feet in height. Each such fence or wall shall <br /> 1975. be so constructed as not to have openings, holes, or spaces larger <br /> Advertised than four (4) inches in any direction, except for doors and gates and <br /> in the except for picket fences where the space between pickets shall not <br /> Lexington exceed four (4) inches." <br /> Minute <br /> Man - or act in any other manner in relation thereto.) <br /> July 10, <br /> 17 & 24, Eric T. M. <br /> Frank Sandy moved to refer this article to the Planning Board and <br /> then withdrew his motion. 8:24 P. M. <br /> Albert P. Zabin moved to amend the main motion by inserting after the <br /> word "pool" and between the word "shall" the words "as defined in <br /> Sec. 422.1 of the Massachusetts State Building Code ". <br /> 8:25 P. M. <br /> Mr. Zabin's motion to amend declared carried by voice vote. <br /> 8:27 P. M. <br /> Motion, as amended, now reads: <br /> MOTION: To amend the Zoning By -Law by inserting a new subsection <br /> 24.8 as follows: <br /> (Motion "Every swimming pool as defined in Sec. 422.1 of the Massachusetts <br /> State Building Code shall be completely surrounded by a fence or wall <br /> as not less than four (4) feet in height. Substituting the words "Zoning Officer" for the words "Building <br /> Inspector" in the first four paragraphs and substituting the words <br /> "Building Commissioner" for the words "Building Inspector" in <br /> subsections 11.2, 11.3 and 11.4. <br /> B. Substituting a new first paragraph to read as follows: "The <br /> Zoning Officer as appointed is hereby designated and authorized <br /> as the officer charged with the enforcement of the 'Zoning By- Law." <br /> 8:28 P. M. <br /> Mr. Clarke presented the Report of the Planning Board which unanimously <br /> recommended the adoption of Article 71 and filed same. <br /> 8:28 P.
