(Motion as attached to the Planning Board Report and as amended <br /> (Cont.) and as adopted: (Cont.) <br /> 7.5.4 STRUCTURES BELOW GROUND: Where the upper elevation of a <br /> structure or building is below the elevation of the natural grade, <br /> and such structure is covered by earth to a depth sufficient to <br /> support vegetation, such structure may be located within a required <br /> front, side or rear yard, but no closer than five feet to a lot <br /> line. Open grates or small ventilation shafts servicing the part <br /> of the structure below ground may be located in the required yard. <br /> 7.5.5 PARKING WITHIN BUILDING: Where a building contains parking <br /> spaces, a parking level shall be counted as a story unless more <br /> than one -half of such level vertically is below the lower eleva- <br /> _........... <br /> (As <br /> Lion as described in subsection 7.5.1A. <br /> adopted) A2) In Section 2, DEFINITIONS, a) by deleting the definition "BUILDING <br /> HEIGHT" in its entirety; <br /> b) in the definition "STORY ", by striking out the existing definition <br /> and inserting in place thereof the following: <br /> "STORY: That portion of a building contained between any floor <br /> and the floor or roof next above it, but not including either <br /> a cellar or the uppermost portion so contained if under a <br /> sloping roof and not accessible, by an approved stairway, or <br /> not designed or intended to be used for human occupancy. ", and <br /> c) in the definition "STORY, HALF": by adding a new second <br /> sentence, as follows: <br /> "Dormers may be constructed on those exterior walls provided <br /> they are structurally supported on the roof rafters and the <br /> length of the dormer(s) as measured between the lowest bearing <br /> points of the dormer(s) on the rafters of the sloping roof <br /> does not exceed 50 per cent of the length of the sloping roof <br /> to which it is attached. <br /> so that the definition as amended will read: <br /> 3 <br /> "STORY, HALF: A story directly under a sloping roof in which <br /> the points of intersection of the bottom of the rafters and <br /> the interior faces of the walls are less than three feet above <br /> the floor level on at least two exterior walls. Dormers may <br /> be constructed on those exterior walls provided they are <br /> structurally supported on the roof rafters and the length of <br /> the dormer(s) as measured between the lowest bearing points of <br /> the dormer(s) on the rafters of the sloping roof does not <br /> exceed 50 per cent of the length of the sloping roof to which <br /> it is attached. <br /> d) in the definition "STRUCTURE" by deleting the second sentence <br /> which reads: ... "However, this definition does not include a <br /> boundary wall or fence less than six feet above the mean finished <br /> grade of the adjoining ground."...; so that the definition as <br /> amended will read: <br /> "STRUCTURE: Anything constructed or erected, the use of which <br /> requires a fixed location on the ground, or attachment to <br /> something located on the ground, including buildings, <br /> mobile homes, billboards, tanks, or the like, or the parts <br /> thereof, and swimming pools." <br /> A3) In Section 7, DIMENSIONAL CONTROLS, by deleting sections: <br /> "7.4.6 Height Limitation Exceptions", and "7.8 Civil Defense <br /> Shelters ", in their entirety, and by inserting in place thereof <br /> "7.4.6 (Reserved)" and "7.8 (Reserved) <br /> A4) In Table 2, SCHEDULE OF DIMENSIONAL CONTROLS, in the line Maxi- <br /> mum height, Other buildings, Stories by deleting the number <br /> where it appears in the columns headed CN AND CG so that in those <br /> districts a 2 story building would be allowed but a 2 story building <br /> would not be allowed. <br /> In Favor: 136 Opposed: 22 <br /> More than the required two- thirds having voted in favor, the <br /> main motion, as amended, was declared adopted. 9:40 P.M.) <br />
