The letter reiterated that the Lexington Conservation Commission has limited jurisdiction over the conservation filing and laid out several options for moving forward. The Commission discussed the options laid out by Mr. Sheehan about how to best handle permitting the project procedurally. The Commission determined that the best option procedurally was to issue the order of conditions under the state act and not the Lexington town bylaws. Mr. Sheehan requested to withdraw the notice of intent application under the Lexington Town Bylaw while keeping the application filed under the State Act. On a motion by Mr. Beuttell and seconded by Mr. Wolk, the Commission voted 4-0 to close the hearing.
