BATTLE Inc. assumed the obligations of the applicant and (2) a GREEN bond obligating said company to observe and perform all VILLAGE covenants, conditions, etc. of the application signed SEC. 2 by the Principal, it was moved by Mr. Jaquith, seconded by Mr. Abbott, and unanimously VOTED: that the July 22, 1957 vote of the Planning Board disapproving the definitive subdivision plan entitled "Battle Green Village Section Two Lexington, Massachusetts," dated May 21, 1957, be and hereby is rescinded. It was further VOTED: that the definitive subdivision plan entitled "Battle Green Village Section. Two Lexington, Massachusetts," dated May 21, 1957, which was submitted to the Board by Eleanor L. Ross on June 7, 1957, accompanied by an application for approval of definitive plan, Form C, dated May 29, 1957, which was disapproved by the Board on July 22, 1957 for failure of the applicant to file the required bond, said dis- approval having been rescinded by the Board on October 8, 1957, and Leeland Construction Co., Inc. having acquired title to all the lands within the subdivision by deed, dated October 8, 1957, recorded in Middlesex South District Registry of Deeds on October 8, 1957 as instrument No. 148, and said corporation having assumed all the obligations of the applicant, be and hereby is approved. i'ORM A Mr. Soule arrived at the meeting at 8:15 p.m. at which time the Board considered the following Form A application for determination of Planning Board juris- diction: #57-89, submitted on October 3, 1957 by Richard K. Brown for Dominic Iovino; plan entitled "A Subdivision of L.C. No. 15791 Land in Lexington - Mass.", Scale 1" = 40', dated July 21, 1957) Miller & Nylander, Civil Engineer's and Surveyors. It was moved, seconded, and unanimously VOTED: that the plan accompanying application #57-89, be signed bearing the endorsement "Lexington Planning Board approval under Subdivision Control Law not required." In making the above determination, it was decided ' to write the following letter to Mr. Brown and to send a copy of the same to Miller and Nylander.
