Planning Board Report on Article 33 - Scenic Roads <br /> Page 2 <br /> PROPOSED MOTION <br /> a) In accordance with Massachusetts General Laws Chapter 40 Section 15C, the Town <br /> designates the following roads as Scenic Roads: <br /> • Fern Street(entire length) <br /> • Shade Street(entire length) <br /> • Vine Street(entire length) <br /> b) Add the following section to the General Bylaws: <br /> § 100-14. Scenic Roads. <br /> Any person violating the provisions of Massachusetts General Laws Chapter 40, Section <br /> 15C, applicable to repair, maintenance, reconstruction, or paving work done to the following <br /> roads designated as Scenic Roads within the Town of Lexington shall be subject to penalties <br /> under Chapter 1, § 1-6 of the General Bylaws: <br /> o Fern Street(entire length) <br /> o Shade Street(entire length) <br /> o Vine Street(entire length) <br /> The Planning Director is authorized to enforce the provisions of this General Bylaw 100-14 <br /> under Chapter 1, § 1-6 of the General Bylaws. Any other legal enforcement action shall be <br /> determined by the Planning Board in consultation with the Planning Board and Town <br /> Counsel. <br /> c) Add the following to Chapter 1, § 1-6(B) of the General Bylaws at the end of the subsection <br /> entitled "Chapter 100, Public Ways and Places." <br /> § 100-14, Violation of Scenic Roads Bylaw, fine schedule: <br /> 1st offense: $100. <br /> 2nd offense: $200. <br /> 3rd and subsequent offenses: $300 per violation. <br />
