Canale,Chair <br /> 1625 Massachusetts Avenue Ginna Johnson,Clerk <br /> Lexington,MA 02420 Nancy Corcoran-RonchettiL I Tel(781)698-4560 Bob Creech <br /> APRI <br /> plar�(ailexingtonnia.gov Charles Hornig <br /> www.lexingtoiniia.�ov/121alu-ing Michael Leon,Associate <br /> REPORT TO THE 2017 ANNUAL TOWN MEETING <br /> ON ARTICLE 33 - SCENIC ROADS <br /> RECOMMENDATION <br /> At its meeting of March 8, 2017, the Planning Board voted four to zero to recommend <br /> APPROVAL of Article 33. <br /> This report was accepted by a vote of four to zero on March 15, 2016. <br /> As he lives on a nominated street, Mr. Canale recused himself from participation on this article. <br /> DESCRIPTION <br /> The purpose of adopting this law is to provide the community, through the Planning Board, an <br /> opportunity to review the repair, maintenance, reconstruction, or paving work done with respect <br /> to scenic roads, including work that involves the destruction of stone walls incidental to <br /> roadwork on accepted town roads that have been designated scenic roads. This review is <br /> applicable to both private and public projects. <br /> Scenic road designation does not give the Planning Board authority over tree work, which <br /> remains with the Tree Warden. However, the law does require that projects affecting both stone <br /> walls and public shade trees on scenic roads must combine the public hearing required by both <br /> statutes. <br /> Should Town Meeting approve this article, the Board intends to draft regulations giving guidance <br /> to applicants. <br /> PUBLIC OUTREACH <br /> As public hearings are not required for General Bylaws, the Board held a public information <br /> session on January 18, 2017, in Battin Hall, in the Cary Memorial Building. The Board <br /> presented the proposed motion and answered a few questions on the article. After deliberations, <br /> the Board removed Bennington Street from the list based on objections from residents of the <br /> street. This underscores the Board's desire to not impose this on any residents that feels strongly <br /> against Scenic Road nomination. All properties on the nominated streets were informed of the <br /> Board's intentions. Opposition was very limited on all other streets. <br /> 1 <br />
