TOWN OF LEXINGTON 133 <br />sented by the majority of our Committee is in certain <br />important respects, far too drastic, and also unnecessarily <br />and unreasonably invades the rights of owners of real <br />estate, we have been unable to agree upon the by-law pro- <br />posed by the majority of the Committee and have there- <br />fore deemed it our duty to the citizens of the town to sub- <br />mit an alternative zoning by-law which we believe duly <br />cares for the rights of a]] property owners affected, and <br />also fully protects the best interests of the town as a whole. <br />The principal points of difference are as follows: <br />1. The minority of the Committee believes that the <br />plan of the majority which restricts by far the larger part <br />of the town to one family dwellings is too drastic, consider- <br />ing the large area of the town now occupied and the minor- <br />ity therefore in the by-law which it presents, provides for <br />dwellings for one and two family houses, instead of only <br />for one family houses and therein substantially follows <br />the provisions of the Zoning By-laws now in force in the <br />towns of Brookline, Milton, Watertown and Winthrop, <br />which we believe will give Lexington ample protection in <br />this respect. <br />2. The minority of the Committee believes that the <br />present industrial and manufacturing interests of the town <br />should be properly protected and reasonable provision made <br />for expansion and development in certain restricted and <br />suitable localities. <br />3. The minority of the Committee believe that the <br />localities best suited for business purposes should not be <br />restricted to residential purposes only. <br />4. The minority of the Committee has ommited in its <br />proposed by-law various provisions which are already suffi- <br />ciently covered by the building laws of the Town, and have <br />thereby sought to avoid the confusion and possible conflict <br />which might arise from including separate and independent <br />provisions in the zoning by-law. <br />We therefore present for your consideration and ap- <br />proval the following by-law which we beleive fully conforms <br />not only to the letter and the spirit of the Zoning Act it- <br />self, but also will serve to fully care for rights of property <br />• <br />134 ANNUAL REPORT <br />ownersaffected, and also protect the best interests of the <br />town in general. <br />Respectfully submitted, <br />DWIGHT F. HARRINGTON <br />TOWN OF LEXINGTON ZONING BY-LAW <br />Regulations as to the Use and Construction of Buildings. <br />ARTICLE 1. <br />Residence Purposes. <br />Section 1. Except as herein otherwise provided no <br />building within the borders of the Town of Lexington shall <br />be erected altered, or used which is intended or designed for <br />any other purpose except one or more of the following: <br />(a) A dwelling for one or more families. <br />(b) A hotel, lodging or boarding house. <br />(c) A club other than a club which is carried on for <br />the purpose of making a profit. <br />(d) A church, school or academy. <br />(e) Other purposes which are not particular indus- <br />tries, trades or manufacturing. <br />(f) A railroad passenger station. <br />(g) A farm, truck garden, nursery or greenhouse. <br />(11) Any accessory purpose customarily incident to <br />the forego nc purposes, and which accessory purpose is <br />not detrimental or obnoxious to the districts where situated. <br />ARTICLE 2. <br />Business Purposes. <br />Section 1. The following districts shall be designated <br />for the carrying on of commercial pursuits, and shall also <br />include any uses permitted under Article 1, namely : <br />District 1. On either side of Massachusetts Avenue <br />from Fottler Avenue, East Lexington, to the northerly <br />line of Curve Street, East Lexington. <br />District 2. On either side of Woburn Street from the <br />westerly line of Cottage Street to Massachusetts Avenue. <br />On either side of Massachusetts Avenue from its junction <br />
