ARTICLE 4 COMMUNITY PRESERVATION FUND <br /> To see if the Town will vote to hear and act on the report of the Community Preservation Committee and, <br /> pursuant to the recommendations of the Community Preservation Committee: (i) to appropriate a sum of money <br /> to the Community Preservation Fund—Historic Reserve; and (ii) to appropriate sums of money from the <br /> Community Preservation Fund for(a) Phase I of the Hancock-Clarke restoration project; (b) a freight elevator <br /> for the Lexington Depot; and (c) shelving for the main vault of the Cary Memorial building; or act in any other <br /> manner in relation thereto. <br /> (Inserted by the Board of Selectmen) <br /> FUNDS REQUESTED. (i) $20,000; (ii) $129,000 <br /> DESCRIPTION This article requests that: (i) funds received from a developer of an historic structure be <br /> added to the Community Preservation funds reserved for historic resources; and (ii) Community <br /> Preservation Funds be appropriated for the listed projects as recommended by the Community Preservation <br /> Committee. <br /> ARTICLE 5 ACCEPT MGL CHAPTER 39 SECTION 23D <br /> To see if the Town will vote to accept Section 23D of Chapter 39 of the Massachusetts General Laws as inserted <br /> by Chapter 79 of the Acts of 2006 relating to attendance at public adjudicatory hearings by members of any <br /> municipal board, or act in any other manner in relation thereto. <br /> (Inserted by the Board of Selectmen) <br /> DESCRIPTION This article proposes that Town Meeting vote to accept a provision of a recent state <br /> law that would allow a member of a Town board, committee or commission to miss one session of an <br /> adjudicatory hearing and still participate in the decision on the matter provided that the member has <br /> viewed a video recording, listened to an audio recording, or read a written transcript of the missed <br /> session and examined any evidence for the record submitted during the missed session. <br /> ARTICLE 6 APPROPRIATE FOR AFFORDABLE HOUSING PURPOSES <br /> To see if the Town will vote to appropriate a sum of money received from Brookhaven at Lexington as a <br /> contribution for affordable housing to LexHAB to support the provision of affordable housing within the Town, <br /> or act in any other manner in relation thereto. <br /> FUNDS REQUESTED. $50,000 <br /> DESCRIPTION This article requests that funds received from Brookhaven at Lexington for affordable <br /> housing purposes be transferred to LexHAB in accordance with the Brookhaven development plan <br /> approved by Town Meeting. <br /> ARTICLE 7 ACCEPT MGL CHAPTER 71, SECTION 37M (JOINT FACILITIES DEPARTMENT) <br /> To see if the Town will vote to accept Section 37M of Chapter 71 of the Massachusetts General Laws relating to <br /> the consolidation of maintenance functions of the School Committee with those of the Town, or act in any other <br /> manner in relation thereto. <br />
