-27- <br /> ARTICLE 86. To see if the Town will vote to amend the Building <br /> By-Law by inserting in ARTICLE III thereof between the definitions <br /> d" "Superintendent of Public Works" and "Veneer" an additional defi- <br /> nition to read substantially as follows: <br /> SWIMMING POOL: Every outdoor artificial pool of water <br /> capable of having a depth of two (2) feet or more at any <br /> point, and used for swimming or bathing, whether excavated <br /> or above ground, together with bathhouses, equipment and <br /> appurtenances used therewith. <br /> ARTICLE 87. To see if the Town will vote to amend the <br /> Building By-Law by adding at the end thereof ARTICLE XXIV to <br /> read substantially as follows: <br /> SWIMMING POOLS <br /> Section 1. Swimming pools are hereby declared to be structures <br /> subject to the provisions of the Building By-Law and <br /> subject also to the following: <br /> A. No swimming pool or part thereof, including <br /> the excavation therefor, shall hereafter be <br /> installed, constructed, altered or repaired <br /> until a permit therefor has been issued by the <br /> Building Inspector and unless such permit is <br /> in full force and effect, except for ordinary <br /> repairs necessary for the upkeep or mainten- <br /> ance of any such swimming pool. <br /> B. Every pool shall be completely surroundedby <br /> a fence or wall not less than five (5) feet <br /> in height. Each such fence or wall shall be <br /> so constructed as not to have openings, holes, <br /> or spaces larger than four (4) inches in any <br /> direction, except for doors and gates and <br /> except for picket fences where the space <br /> between pickets shall not exceed four (4) <br /> inches . <br /> C. All gates or openings through such enclosure <br /> shall be not less than five (5) feet in height <br /> and shall be equipped with a self-closing and <br /> self-latching device for keeping the gate or <br /> door securely closed at all times when not in <br /> actual use, except that the door of any dwelling <br /> which forms a part of the enclosure need not be <br /> so equipped. <br /> D. If intended for use during the hours of darkness, <br /> suitable illumination shall be provided which <br /> shall be shielded from shining upon any street <br /> or adjoining property. Underwater pool lights <br /> shall be 12 volts or less and must be supplied <br /> from an isolating transformer. <br />
