12. <br /> ARTICLE 39. To see if the Town will authorize the Selectmen in <br /> the name and on behalf of the Town to sell and convey, subject to <br /> such existing easements, reserving to the Town such additional <br /> easements, and upon such other terms and conditions , as the Selectmen <br /> may determine, all or any part or parts of a certain parcel of land <br /> on Waltham Street that was acquired in 1955 from Herman B. MacKay and <br /> Margaret R. MacKay as a part of the off-street parking area situated <br /> between Waltham Street and Muzzey Street , and is no longer needed by <br /> the Town, and will set the minimum amount or amounts to be paid for <br /> such conveyance or conveyances ; or act in any other manner in <br /> relation thereto. <br /> ARTICLE LEO. To see if the Town will vote to transfer to the <br /> School Committee for school, playground or recreational purposes, <br /> and for all purposes incidental thereto, the care, custody, <br /> management and control of part of the land conveyed to the Town by <br /> Augustus E. Scott by deed dated March 30, 1915 which is recorded in <br /> Middlesex South District Registry of Deeds Book 3981, Page 109, the <br /> conditions set forth in said deed limiting the use of the land to park <br /> and playground purposes having been released to the Town by the <br /> Trustees of Tufts College, the successor as residuary legatee and <br /> devise under the will of said Augustus E. Scott of any rights to <br /> enforce said conditions, and use of said land for school, playground <br /> or recreational purposes, and for all purposes incidental thereto, <br /> having been authorized by Chapter 114 of the Acts of 1961; or act <br /> in any other manner in relation thereto. <br />
