November 8,2021 Special Town Meeting#1(2021-1),cont. <br /> MOTION: <br /> Ms.Hai moves that the Select Board be authorized to grant an easement to the Town of Burlington to <br /> install,construct and maintain a water line within Lowell Street and North Street in the area shown on <br /> the plan entitled"Town of Burlington Phase 2A-24"Water Main Replacement Project",prepared by <br /> Wright Pierce and dated July 22,2021,a copy of which is on file with the Town's Department of Public <br /> Works,on such terms as the Select Board deem appropriate. <br /> 7:55 p.m. The Moderator called the Members to vote on the Consent Agenda. <br /> 7:56 p.m. Steven Heinrich,Pct.3,noted a Point of Order and discussed how the CPC funds <br /> seemed to neglect to provide for middle-aged children in the planning and he hoped <br /> that would be remembered in the future. <br /> 7:58 p.m. Marilyn Fenollosa,Historical Commission Chair,stated that the Recreation <br /> Department had heard the message loud and clear and that they were having <br /> conversations with the community regarding acceptability of the Rindge project and <br /> more information could be asked of the Recreation Director. <br /> 7:59 p.m. The Moderator stated that this seemed to be a conversation that should be taken off- <br /> line as voting was in process. <br /> Following remote electronic vote tallying,the Moderator declared the: <br /> Motion to Approve the Consent Agenda <br /> Adopted on a vote of: <br /> Yes No Abstain <br /> 176 0 4 <br /> MOTION UNANIMOUSLY CARRIES <br /> 8:00 P.M. The Moderator recognized Mr.Hornig,Chair of the Planning Board,to offer a few <br /> remarks. Mr.Hornig stated the following: <br /> "On behalf of the Planning Board,I would like to take this last opportunity to thank <br /> Amanda Loomis,our outgoing Planning Director,for all her work both in support of <br /> the Planning Board and the whole Town of Lexington. <br /> "Ms.Loomis arrived 2 years ago at the end of a difficult period for the Planning <br /> Office and Planning Board and at the beginning of a worldwide pandemic. She guided <br /> the Board into this new world of virtual meetings,welcomed our new members,and <br /> made it possible for the Board to propose and Town Meeting to adopt zoning changes <br /> covering everything from basement floors to cell towers.Less visibly,she led the <br /> effort to update the Planning Board's development regulations and worked with the <br /> rest of the staff to keep up with a permitting workload that has only increased during <br /> the pandemic. <br /> "We wish Ms.Loomis the best in her future efforts and look forward to working <br /> productively with our remaining staff." <br /> 8:02 p.m. Mr.Hornig asked that Mr.Robert Peters be recognized for Article 12, 13, 14, 15,and <br /> 16. <br /> Mr.Peters motioned to receive the written reports of the Planning Board for Articles <br /> 12, 13, 14, 15,and 16 and place them on file with the Town Clerk. <br /> 8:02 p.m. As there were no objections,the Moderator declared Town Meeting open on Article <br /> 12. <br /> ARTICLE 12:AMEND ZONING BYLAW-STRUCTURES IN YARDS <br /> To see if the Town will vote to amend the Zoning Bylaw to update certain provisions related to walls, <br /> fences,and structures in yards,including: adding a definition of"fence-,limiting the height of fences <br /> and retaining walls near lot boundaries; permitting structures enabling access for disabled persons <br /> anywhere on a lot;prohibiting structures in yards that interfere with safe stopping sight distance on a <br /> street;making the definition of"yard"consistent with other provisions of the bylaw;or act in any other <br /> manner in relation thereto. <br />
