DESCRIPTION: The Zoning By-Law provides for"planned development districts"that <br /> appear in only one location in town. There are currently 17 such districts. The procedure <br /> calls for a preliminary site development and use plan(PSDUP) that has a detailed site plan <br /> and special provisions that apply to a particular use of the land. The proposed amendments <br /> add to, remove or clarify the provisions that deal with Town Meeting amendment procedures <br /> and the action of the Board of Appeals in approving or revising a special permit with site <br /> plan review that is required for each planned development zoning district. <br /> ARTICLE 8 ZONING BY-LAW,AUTOMATIC TELLER MACHINES <br /> To see if the town will vote to amend the Zoning By-Law of the Town of Lexington, as follows: <br /> In Section 4.2, Table 1, Permitted Uses and Development Standards,Part B, Commercial Uses, in <br /> line 7.15a under the description of the uses,by striking out the word "external," and adding at the <br /> end of the line"which may be either a principal use or an accessory use," and under the column <br /> headed by CN by striking out the letter"N" and inserting the letters "SP"; or act in any other <br /> manner in relation thereto. <br /> (Submitted by Deirdre W.Niemann and nine or more registered voters) <br /> DESCRIPTION: The proposed amendment clarifies that Automated Teller Machines, <br /> either free-standing or contained in or on a building as an accessory use, are conditionally or <br /> fully permitted in all commercial districts. <br /> ARTICLE 9 ZONING BY-LAW, CN AND RO TO CD <br /> 903 WALTHAM STREET <br /> To see if the Town will vote to amend the Zoning By-Law and Zoning Map of the Town of <br /> Lexington by changing the zoning district designation of the land described below from the current <br /> CN,Neighborhood Business District and RO, One-Family Dwelling District to CD, Planned <br /> Commercial District, said property being commonly known and numbered as 903 Waltham Street <br /> (the Chadwick's Property) and located at the corner of Waltham Street and Concord Avenue,to <br /> allow construction of a new building(s)to house retail neighborhood businesses; or act in any other <br /> manner in relation thereto. <br /> (Submitted by Fox and Hound Properties, Inc.,the property owner) <br /> DESCRIPTION: The proposed amendment would rezone the former Chadwick's Ice <br /> Cream property from the present combination of Commercial Neighborhood and RO single <br /> family to a special Planned Commercial Development district.
