285` <br /> 1997 Annual Town Meeting-March 24, 1997 rout <br /> Article 30 continued.... <br /> Leo McSweeney stated unanimous support of the Board of Selectmen. <br /> 8:47 p.m. Ephraim Weiss, Pr. 5, asked for clarification of the map that was <br /> presented. Mr. McSweeney asked the Moderator to recognize <br /> Marshall Derby of LexHAB. <br /> The Moderator stated that as the article requires a two-thirds vote,if the vote is not <br /> unanimous then a standing vote will be taken. Following a voice vote at 8:48 p.m., <br /> the Moderator declared adoption of the motion under Article 30, by unanimous vote. <br /> ARTICLE 35: LAND TRANSFER <br /> 8:50 p.m. Presented by Carolyn Wilson,Pr. 2. <br /> MOTION: With respect to the parcels described in this article, that the <br /> P� P <br /> Conservation Commission be authorized to purchase or otherwise acquire, and the <br /> Selectmen be authorized to take by eminent domain, upon the written request of <br /> the Conservation Commission,and that the Selectmen be authorized to transfer for <br /> conservation purposes and for recreational uses as approved by the Recreation <br /> Committee any fee, easement or conservation restriction as defined in Section 31 <br /> of Chapter 184 of the General Laws, or other interest in all or any part of such <br /> parcels. <br /> Carolyn Wilson, Pr. 2, asked the Moderator to recognize Lynn Knight of Liberty <br /> Heights,who presented the article. <br /> 'I 8:55 p.m Selectman Daniel Busa stated unanimous support of the Board of <br /> Selectmen. <br /> 8:55 p.m. Richard Canale stated support of the Planning Board. <br /> 8:55 p.m. Joyce Miller stated unanimous support of the Conservation <br /> Commission. <br /> The Moderator stated that as the article requires a 2/3 vote, if the vote is not <br /> unanimous then a standing vote will be taken. Following a voice vote at 8:55 p.m., <br /> the Moderator declared unanimous adoption of the motion. <br /> ARTICLE 34: IN LIEU OF TAX PAYMENTS BY LEXHAB <br /> 8:57 p.m. - Presented by Dawn McKenna,Pr. 9, at the request of Laurie Rice, <br /> sponsor of the motion,from Pr. 2. <br /> MOTION: That LexHAB be requested to make annual payments in lieu <br /> of taxes to the Town of Lexington in an amount not less than 20%of its gross <br /> revenues to help support town services utilized by its rental units. <br /> 9:05 p.m. Marshall Derby of LexHAB stated he would like to follow precedent <br /> of the Lexington Housing Authority in its 10%contribution of gross <br /> revenue less utilities. <br /> Marshall Derby moved to amend the motion by replacing"20%of its gross revenues" <br /> with "10%of its gross revenues as reduced by utility fees and condominium fees". <br /> 9:10 p.m. Selectman Daniel Busa stated the majority of the Board of Selectmen <br /> supported the amendment. The Board,however,does not support the article. <br /> John Davies,Planning Board,stated the Planning Board's favoring of the amendment <br /> as a second choice,but recommends,disapproval of the article. <br />
