Wilson, Jeanne K. Krieger, Leo P. <br />McSweeney, David G. Williams and Associate Member Richard A. Michelson <br /> <br />Staff Present: David George, Zoning Administrator <br /> <br />Address: 5 Rumford Road, Map 46, Lot 18 <br /> <br />The petitioner submitted the following information with the application: nature and <br />justification of request, topographic plan, plot plan, elevations, floor plans, photographs <br />and e-mail dated August 21, 2013 from Carl Toumayan confirming the rear yard <br />setback. <br /> <br />Prior to the hearing, the petition and supporting data were reviewed by the Acting <br />Building Commissioner, Conservation Administrator, Town Engineer, Board of <br />Selectmen, the Zoning Administrator, the Planning Director, Economic Development <br />and the Historic Districts Commission Clerk. Comments were received from the <br />Zoning Administrator. <br /> <br />The Chairman duly opened the hearing by reading the legal notice and described <br />information received from the petitioner. <br /> <br />The applicant is requesting a VARIANCE from section 135-4.1.1, Table 2, Schedule of <br />Dimensional Controls and 135-9.2.2 to allow a rear yard setback of 2.4 ft. instead of <br />the required 15 ft. rear yard setback. <br /> <br />Attorney Carl Toumayan representing the owners of the property, Tomasz Nowina- <br />Konopka and Malgorzata Zurakowska-Konopka, presented the petition. <br /> <br />At the hearing Attorney Toumayan explained the proposed addition and the owners <br />wish to keep the integrity of the house as it was designed in the 1950’s. <br /> <br />A Board member asked Attorney Toumayan to explain the paper street. He answered <br />title search had not been done, according to the deed the paper street is outside the <br />owners locus. <br /> <br />Dimitri Vlachos of 286 Woburn Street asked the Board member for clarification of the <br />paper street, the abutters are not clear as to who owns it and asked how wide the <br />paper road is. The Board member suggested he consult a real estate lawyer. <br /> <br />Attorney Toumayan answered Mr. Vlachos the paper road is 20 ft. wide. Without <br />doing a title plan it is difficult to say. <br /> <br />Mr. Vlachos asked to see the plans. <br /> <br /> <br /> <br />
