BOA Meeting September 12, 2013 5 <br />Minutes of the Lexington Zoning Board of Appeals <br />Selectmen’s Meeting Room <br />September 12, 2013 <br /> <br />Board Members Present: Chairman – Carolyn C. Wilson, Jeanne K. Krieger, Leo P. <br />McSweeney, Martha C. Wood and Associate Member Richard A. Michelson <br /> <br />Staff Present: David George, Zoning Administrator <br /> <br />Address: 16 Franklin Road, Map 56, Lot 118 <br /> <br />The petitioner submitted the following information with the application: nature and <br />justification of request; a mortgage plot plan, elevations, floor plans, photographs and <br />six e-mails in support of the project. <br /> <br />Prior to the hearing, the petition and supporting data were reviewed by the Building <br />Commissioner, Conservation Administrator, Town Engineer, Board of Selectmen, the <br />Zoning Administrator, the Planning Director, Economic Development and the Historic <br />Districts Commission Clerk. Comments were received from the Zoning Administrator. <br /> <br />The Chairman duly opened by reading the legal notice and described information <br />received from the petitioner. <br /> <br />Kerry Brandin, owner of the property, presented the petition by explaining the <br />modification of a portion of the existing second and third floors to create a by-right <br />accessory apartment. Sitting with Kerry was her Architect, Pam Bart. <br /> <br />The applicant is requesting a variance from sections 135-9.2.2.2 and 135-6.7.6.3 to <br />allow an accessory apartment with 1,300 sq. ft. gross floor area instead of the <br />maximum allowed 1,000 sq. ft. of gross floor area. <br /> <br />A Board member asked to clarify the parking accommodations. The Zoning <br />Administrator stated the applicant currently has sufficient parking according to By-Law <br />requirements however applicant needs to understand that any additional parking <br />would need to stand alone without moving any other vehicles. <br /> <br />There were no questions from the audience. <br /> <br />No one spoke in opposition to the petition. <br /> <br />Margaret Gibbons of 24 Somerset Road spoke in favor of the application. <br /> <br />The hearing was duly closed. <br /> <br />On a motion by Richard Michelson and seconded by Jeanne Krieger, the Board voted <br />5-0 to grant a variance from sections 135-9.2.2.2 and 135-6.7.6.3 to allow an <br />accessory apartment with 1,300 sq. ft. gross floor area instead of the maximum <br />allowed 1,000 sq. ft. of gross floor area. <br /> <br />Submitted by: Dianne Cornaro, Administrative Clerk <br /> <br />
