HomeMy WebLinkAbout1975-03-20 BOARD OF APPEALS HEARINGS IllMarch 20, 1975 A regular meeting of the Lexington Board of Appeals was held on Thursday, March 20, 1975 at 7 30 p m in the Selectmen's Meeting Room of the Town Office Building Present were three regular members and two associates as follow Vice Chairman, Acting Chairman George P Wadsworth, regular members Woodruff M Brodhead; Ruth Morey, and associate members Natalie H Riff in and Irving H Mabee Also present were a Minute-Man reporter, LWV Observer and a room full of townspeople Public hearings were held on the following petitions, notice having been mailed to those who should legally receive them and to town boards and offi- cials who will or might be affected by decisions made and also advertised in the Lexington Minute-Man newspaper James B Catalano - special permit renewal, pursuant to Section 25 33, to con- tinue operations of retail business of selling flowers, produce and plants grown on the premises at 643 Waltham Street Herman E Erikson - variance of Section 27 of the Lexington Zoning By-Law to allow a frontage of 129 36 ft instead of the required 150 ft for Lot 5 in the Piper Ridge Subdivision located at the corner of Piper Road and Waltham Street Jeffrey Bromberg - permission to extend the hours for serving food at the Deli-Shuss at 1841 Massachusetts Avenue, under Board of Appeals special permit, from 8 a m through 10 p m to 6 a m through 12 o'clock midnight Michael R Fullerton and Denis J Fullerton, Jr - special permit, pursuant to Section 25 94, so as to allow for the storage of not more than twenty (20) bicycles in the basement of the property at 2400 Massachusetts Avenue The bicycles shall be used in connection with a bicycle rental operation to be conducted elsewhere The petitioners are sons of the owner Following the hearings the Board made the following decisions, all in public open meeting Catalano - Granted, subject to the following conditions 1 The premises shall be kept in a neat and orderly condition at all times 2 No flood lights shall be used 3 Sufficient parking space shall be provided so that cars shall not be parked on the street 4 Only one sigh shall be permitted 5 This permit shall expire March 20, 1977 Erikson - Granted, subject to the condition that any requirements of the Board of Health must be met This permit does not exempt the petitioner from obtain- ing any other permit required by statute and in accordance with State law, before this permit for variance becomes effective, notice that such a permit has been issued must be recorded at the Registry of Deeds by the Petitioner March 20, 1975 hearings (continued) -2 Bromberg. - granted, subject to the approval of the Board of Selectmen Fullerton - granted, subject to the condition that it be restricted to two years during the months of April to October Permit expires October 31, 1976 All pertinent material is on file in the Board of Appeals' office The meeting adjourned at 9 30 p m Respectfully submitted, Evelyn F Cole, Clerk I I
