Lexington Board of Health Meeting, Wednesday, May 9, 2012, at 7:00 p.m.

Wendy Heiger-Bernays called the meeting to order at 7:00 p.m.
The Board reviewed the minutes of April 11, 2012. Perlmutter motioned to accept the
minutes as written. MacKenzie seconded. All approved.
Environmental Health Report – Food Inspection Program
Environmental Health Reports – The Board reviewed the Environmental Health Report
for April 2012.
Via Lago – Cody informed the Board that Via Lago had submitted a building permit
application for new equipment. As a result, the Building Commissioner sent Via Lago a
letter advising them to contact the Health Department concerning the proposed building
work. The owner’s response to the Health Department was immediate and a reinspection
will be conducted after completion of building permit.
Pool Variance Request – The Lexington Board of Health grants the variance request from
the requirement of lifeguards for the safe operation of pools as listed under
105 CMR 435.23(1). In addition, all the requirements of 105CMR 435.23(2) shall be met
including all signage which includes: “Warning No Lifeguard on Duty” in easy to read,
legible letters which are at least four inches high “Children under age 16 should not use
swimming pool without an adult in attendance” and another sign that states, “Adults
should not swim alone”. This variance applies only to the following seasonal pool
facilities, which have made the request in writing. They are listed as follows:
1.Drummer Boy Green Condominium
2.Avalon at Lexington Hills
3.Avalon at Lexington Ridge
4.Pleasant Brook Pool Association
5.Adams Pool
6.Moon Hill Community Pool
7.Quality Inn & Suites
8.Element Hotel
9.Aloft Hotel
10.Peacock Farm Association
11.Paint Rock Pool
This variance will expire at the end of the Seasonal Pool season or upon notification of an
unsafe operating condition at a specific facility.
New Housing Cases
24 Oxbow Road – Cody advised the Board that as a result of a request by the tenant, he
performed a lead paint determination. This determination found lead paint in violation of
the Lead Law and owner of the property was sent a letter on April 13, 2012, requesting
that a private lead inspector conduct a comprehensive lead inspection. Cody mentioned
that if the tests are positive, the owner will need to do a complete deleading, the tenants
will need to vacate the property and they should see their physician.
Lexington Health Care Facility at 178 Lowell St. – Cody updated the Board concerning a
nuisance complaint at Lexington Health Care Facility. This facility was recently updated
this complex with newer generators that would not fail during an emergency. They
located the generator next to a patient’s window without any sound barrier protection.
This generator is tested every Wednesday for ½ hour and neighbors are complaining
about the sound as well as the strong diesel exhaust odor. The facility manager advised
Cody that he is working with Corporate to hire an acoustic engineer to create barriers
around the device. Cody has not heard back from them about the remedy for the strong
diesel exhaust.
Community Health Update/Report – The Board reviewed the Community Health Report
for April 2012 prepared by David Neylon, R.N., and follow-ups for the 6 communicable
diseases had been done in a timely manner.
Bowman and Bridge Schools – Dust Monitoring Update - Cody updated the Board
concerning the dust monitoring program being implemented at the Bridge and Bowman
Schools during rennovations. After a discussion, the Board recommended using the EPA
tools for schools as guidance.
Organic Waste Processing – Jay Flynn updated the Board concerning his meeting with
Representative Jay Kaufman about the Organic Waste Processing. A discussion
followed. Heiger-Bernays motioned to appoint John J. Flynn as Acting Board of Health
Chairperson for the May 15, 2012 meeting to review the RFP process. MacKenzie
seconded. All approved.
Emergency Preparedness – Cody informed the Board about a Table Top Exercise to be
held in July dealing with best practices for emergency sheltering.
Perlmutter motioned to adjourn. MacKenzie seconded. All approved.
