Lexington Board of Health Meeting, Wednesday, April 11, 2012, at 7:00 p.m.

Wendy Heiger-Bernays called the meeting to order at 7:00 p.m.
The Board reviewed the minutes of April 11, 2012. Perlmutter motioned to accept the
minutes with corrections. MacKenzie seconded. All approved.
Environmental Health Report – Food Inspection Program
Starbucks Coffee, 1729 Mass Avenue – Daniel Brennan of dpb Consulting Services and
Nicholas Lawrence of Starbucks appeared before the Board of Health requesting a
variance to have a mechanical warewasher instead of a 3-bay sink for cleaning and
sanitizing food contact equipment and utensils for their proposed renovation. After a
discussion, Perlmutter motioned that the Lexington Board of Health grants a variance
from FC 4-301.112 to use a mechanical ware wash machine to Starbucks Coffee at 1729
Massachusetts Avenue. MacKenzie seconded. All approved.
ButterGirl Baking Company, 12 Moon Hill Road (Residential Kitchen) – Laurelyn
Roberts, Owner of ButterGirl Baking Company had completed a food plan review with
the Health Division. All applicable equipment, (except for a mop sink and hand washing
facilities) had been installed according to code. Ms. Roberts submitted variance requests
to use a bathroom toilet as a mop sink and to use a kitchen sink as a hand washing sink
After a discussion, Perlmutter motioned that the Lexington Board of Health grants an
annual permit and a variance from FC 5-203.13 and FC 5-203.11 to operate a residential
kitchen at 12 Moon Hill Road as ButterGirl Baking Company. Geller seconded. All
approved.
New Housing Cases
24 Oxbow Road – Cody advised the Board that he received a call from a tenant at 24
Oxbow Road who was concerned about lead paint because there are two children under
the age of six. Cody did a lead determination inspection and it indicated two specific
locations that were positive for lead. Cody notified the Childhood Lead Prevention
Program along with a copy of the report. A specific order to correct has been sent to the
landlord.
Avalon - 12266 Main Campus Drive – Cody informed the Board that he received a
complaint from a tenant who is concerned about chronic dampness at the above
referenced apartment.
Community Health Update/Report – The Board reviewed the Community Health Report
for March 2012 prepared by David Neylon, R.N., and follow-ups for the communicable
diseases had been done in a timely manner.
Environmental Health Reports – The Board reviewed the Environmental Health Report
for March 2012. MacKenzie mentioned that she would like to see listed on the report the
actual violations causing the reinspection.
15 Saddle Club Road – Cody asked the Board to review a letter to be sent to resident at
15 Saddle Club Road. Cody advised the Board that he recently spoke with MDEP and
they issued some guidelines for dual use geothermal wells in January 2012. MDEP does
require water testing and a backflow preventer. Cody stated that in October 2011,
Lawrence Sweet, Alternate Plumbing Inspector had sent this resident an order to correct
letter to fix the backflow preventer issues. To date, there has been no response.
Miscellaneous Updates
Rabies Vaccination Day – Cody advised the Board that a rabies vaccination clinic was
held outside Cary Hall on April 7, 2012. About 15 animals arrived and 12 were eligible
to be vaccinated for rabies.
Medical Waste Collection – A medical waste collection was also held on April 7, 2012.
Cody informed the Board that 90 residents participated in the program.
Perlmutter motioned to adjourn. MacKenzie seconded. All approved.
