Geller; Burt Perlmutter; John J. Flynn; Sharon MacKenzie Health Department Attendees: Gerard F. Cody, Health Director; Ann Belliveau, Health Clerk/Office Manager Wendy Heiger-Bernays called the meeting to order at 7:00 p.m. The Board reviewed the minutes of January 10, 2012. Perlmutter motioned to accept the minutes as written. MacKenzie seconded. All approved. Environmental Health Report – Food Inspection Program Qdoba Mexican Grill – Gerard Cody introduced Francis Diaz, Regional Manager for Qdoba Mexican Grill in Massachusetts. Mr. Diaz Qdoba Mexican Grill has completed the food plan review with the Health Division but they are awaiting building renovations before the final inspection. Diaz explained that there will be a full service kitchen but there will not be any wait staff. Heiger-Bernays asked if there will be staff present at all times who are Serve Safe Certified. Diaz responded that shift managers will be ServSafe certified. Heiger-Bernays asked Diaz if there will be staff present at all times who are serve safe certified. Heiger-Bernays mentioned to Diaz that free safe food handling workshops offered by the Health Department and Diaz stated he would like to have staff attended these workshops. Diaz hopes to open June 5, 2012. After a discussion, Perlmutter motioned that the Lexington Board of Health grants an annual permit to operate a food establishment to Qdoba Mexican Grill at 46 Bedford Street upon successful completion of a pre-operational inspection. MacKenzie seconded. All approved. 50 Bridge Street - Variance from the requirement of the two acre minimum to obtain an animal permit for the keeping of more than 5 (five) chickens. Cody introduced Ellen McDonald and Ben Schlosser of 50 Bridge Street to the Board who is requesting a variance from the requirement of a two acre minimum to obtain a permit for keeping 50 chickens. Heiger-Bernays asked why 50 chickens? Schlosser stated that they are trying to develop feed systems for backyards that can be replicable and in order to test the system on moderate scale a fair number of birds are necessary to make sure the system will work as the number of birds increase or decrease. Schlosser would like to test feeds in this controlled setting and to be able to use it in other locations. They hope to use the manure as a compost product at this residence. After a discussion, the Board determined they would need to see a plan dealing for the manure indicating where is it going and how is it getting there because of the size of the lot and the residential neighborhood along with a plan concerning what will happen to all of the eggs. Orange Leaf – Cody introduced James Berberian and Jim Alex of Orange Leaf to the Board. Alex advised the Board that this new yogurt establishment will be a self-serve yogurt establishment offering 16 yogurt flavors with 48 different toppings. The yogurt will be tested monthly. Cody advised the Board of the free food training being offered on March 26, 2012, as the person-in-charge local regulation requires that a ServSafe Certified person-in-charge be present at all times. After a discussion, Geller motioned that the Lexington Board of Health grants an annual permit to operate a food establishment to Orange Leaf at 1726 Mass Avenue upon successful completion of a pre- operational inspection. Berberian advised the Board that the machines will be broken down and cleaned every other day and the yogurt will be tested monthly. MacKenzie seconded. All approved. Prime Roast Beef – Tony Tzovoras of Prime Roast Beef appeared before the Board for his brother Evan Tzovoras who is the new owner of this establishment. Tzovoras advised the Board that nothing is changing from the previous owner. Cody reminded Tzovoras that a ServSafe certified person-in-charge must be present at all times. Tzovoras mentioned that the grease is picked up monthly and the grease trap is cleaned monthly. MacKenzie motioned that the Lexington Board of Health grants an annual permit to operate a food establishment to Prime Roast Beef at 321 Marrett Rd. Brookhaven Pool Variance Request – Cody informed the Board of Brookhaven’s request for a variance from the provisions of 105 CMR 435.23(1) Lifeguards with respect to the swimming pool and spa facility located at Brookhaven, 1010 Waltham Street. After a discussion, Flynn motioned to grant the variance request from the requirement of lifeguards for the safe operation of pools as listed under 105 CMR 435.23(1). In addition, all the requirements of 105 CMR 435.23(2) shall be met including all signage which includes: “Warning No Lifeguard on Duty” in easy to read, legible letters which are at least four inches high “Children under age the age of 16 should not use swimming pool without an adult in attendance” and another sign that states, “Adults should not swim alone”. MacKenzie seconded. All approved. Community Health Updates/Reports – The Board reviewed the Community Health Report for February/March prepared by David Neylon, R.N., and follow-ups for the communicable diseases had been done in a timely manner. Environmental Health Reports – The Board reviewed the Environmental Health Reports and Inspection Reports for January and February 2012. 15 Saddle Club Road – There was a brief discussion concerning the well water analytical results. Cody advised the Board that he has not received the analytical results. The Board would like to have a reminder letter sent to the property owner. Organic Waste Processing – Felix Zemel updated the Board concerning the state of the regulations. Zemel stated that any changes to the definition of solid waste would require a legislative action because it is statutory not regulatory. A discussion followed. 11 Ross Road – Cody informed the Board that the landlord had corrected all the violations and this complaint is now closed. Perlmutter motioned to adjourn. MacKenzie seconded.
