Prior to the hearing, the petition and supporting data were reviewed by the Building Commissioner, Conservation Administrator, Town Engineer, Health Director, Board of Selectmen, the Zoning Administrator, the Planning Administrator and the Historic Districts Commission Clerk. Comments were received from the Building Commissioner and the Zoning Administrator. The Chairman opened the hearing at 7:30 pm by reading the legal notice and described information received from the petitioner relative to the petition. Deanna and Eric Campbell, owners of the property, presented the petition explaining the planned addition. The applicant is requesting a Variance in accordance with 135-35A, Table 2, Schedule of Dimensional Controls of the Zoning Bylaw to allow a front yard setback of 24' instead of the rquired 30 ft. The Chairman asked for clarification as to what was happening with the extension that was being taken down and replaced. A Board member asked about the stairs referenced by the Building Department. They are planning just a stone step up or regarding so that there is no step. The Zoning Administrator requested the applicant go to the Building Department with the plans so they can determine if they would need another variance. There were no questions from the audience. Mary Burnell of 40 Eaton Road spoke in support of the petition. No one spoke in opposition of the petition. The hearing was duly closed. BOA Meeting April 14, 2011 2 On a motion by Carolyn C. Comments were received from the Conservation Administrator and the Zoning Administrator. The Chairman opened the hearing at 7:36 pm by reading the legal notice and described information received from the petitioner relative to the petition. Barnet Berliner, Architect, presented the petition for the owner of the property, Luishun Lau. Mr. Berliner explained the hardship as the topography of the land in the front of his house. His land is low compared to the opposite side of the street. During the winter he has a problem with snow piling up in front of his house, he feels a garage would help him not to have to shovel his car out. The applicant is requesting a Variance in accordance with 135-35A, Table 2 Schedule of Dimensional Controls of the Zoning Bylaw to allow a front yard setback of 10.9' instead of the required 30 ft front yard setback. A Board member asked if the garage is not approved would the applicant be removing the driveway. The driveway would be moved to the middle of the front and each neighbor would have a garden area by the driveway. Amos Becker of 39 Bridge Street asked if the by-laws had changed regarding setbacks. He had applied for a variance for a 28 ft front yard setback many years ago to rebuild a garage and it had been denied by the Board. No one spoke in favor of the petition. David Farrar of 45 Bridge Street and Amos Becker of 39 Bridge Street spoke in opposition. BOA Meeting April 14, 2011 4 The applicant and the Board spoke about a portico/canopy over the front door that was on the proposed plans submitted with the application. Since the garage is not going to be built the applicant is asking for the canopy to be a little bit bigger than on the plans submitted. The canopy would be 14.9’ long by 6’ deep and would have a 24’ front yard setback. With the canopy the applicant is asking for a setback less than what was advertised for the garage. The Zoning Administrator requested a mark up exhibit of the canopy with the exact work being done. The Chairman asked if there were any additional comments in favor or in opposition to the canopy. There were none. The Chairman closed the hearing at 7:53. Decision: On a motion by Carolyn C. Wilson and seconded by Martha C. Wood, the Board voted 5-0 to approve the Variance in accordance with 135-35A, Table 2 Schedule of Dimensional Controls of the Zoning Bylaw to allow a front yard setback of 24' instead of the required 30 ft front yard setback for the purpose of a canopy over the front door as presented on the plans submitted at the hearing. Ira Berstein, owner of the property, presented the petition. The applicant is requesting a Variance in accordance with 135-35A, Table 2 Schedule of Dimensional Controls of the Zoning Bylaw to allow a front yard setback of 26.2 ft instead of the required 30 ft. front yard setback for a proposed family room. The applicant received a Variance in 2007 for the roof overhang on the garage. At the hearing the applicant addressed the concerns of the Conservation Administrator and the concern of the Zoning Administrator regarding the hardship for the petition and the reconstruction of the front stoop. He is using the same reasoning for the hardship as was used for the 2007 decision. The applicant presented the Board with 2 letters of support from the abutters at 5 Butler Avenue and 47 Carville Avenue and a copy of the 2007 decision for a variance for a 21 ft. front yard setback. The Zoning Administrator asked if the 2007 decision had been filed with the registry of deeds in Cambridge. A Board member asked if the 2 trees in the front coming down. They are not. There were no audience questions. No one spoke in favor or in opposition to the petition. The applicant is requesting a Special Permit in accordance with section 135-9F to allow temporary use of an existing house until new construction of a single family dwelling is completed. Attorney Grant explained the need for the family to reside in the existing structure due to a family member’s autism and his need for continuity in this situation. McWeeney, the Board voted 5-0 to approve a Special Permit in accordance with section 135-9F to allow temporary use of an existing use until new construction is completed with the following conditions as agreed upon by the applicant: 1.The existing dwelling shall be removed within thirty (30) days after a certificate of occupancy has been issued for the new structure. 2.Only one dwelling shall be occupied at any one time. 3.Construction of the new single family dwelling and demolition of the existing dwelling shall be completed within 2 (two) years of the date of the building permit for new construction unless extended by the ZBA. 4.A Construction Management Plan, in a form suitable to the Building Commissioner and Zoning Administrator, shall be submitted with the building permit application. The applicant is looking to modify the structure for their handicapped child by adding a vertical addition over the nonconforming sunroom, located within the right hand side yard setback and to add an addition from the main structure to the nonconforming garage which is located within the left hand side-yard setback. At the hearing the applicant presented letters of support from Mark Sommer and Ellen Baker of 32 Vine Brook Road and Kathy Taudvin of 28 Vine Brook Avenue. A Board member asked if the circular drive was a necessity. Mr. Smith explained it allows them to get a safe accessible route from the existing driveway. There were no audience questions. The Chairman opened the hearing at 8:26 pm by reading the legal notice and described information received from the petitioner relative to the petition. Trista Perez Kennealy, potential owner of the property, presented the petition. Attorney Edmund Grant also presented information to the Board. The applicant is requesting a Special Permit in accordance with 135-28C and section 135-11 A2 to allow substitution of a non conforming use. Ms. Kennealy explained that she is in the process of buying the Dana Home with the long term intent of turning the home into an Inn. In the interim while she is going thru the process of the special permitting and zoning requirements with the Lexington Town Meeting she is requesting a special permit from the ZBA to maintain the use of the existing commercial kitchen to run a proposed off premise catering service. A Board member asked how the applicant felt with the list of conditions that were proposed by the Zoning Administrator. The Chairman summarized the typical general conditions that are part of decisions of this type. Another Board member asked the applicant to comment on the extension of the commercial use into a residential zone. Attorney Grant explained this request is a substitution of an existing non conforming use to the Board. The home was legally nonconforming use because the use was before zoning. Attorney Grant said the applicant will need to come before the Board again once they receive approval from Town Meeting for the Inn and Catering Business. BOA Meeting April 14, 2011 15 The Board member asked for clarification of the catering business once it is approved as an Inn. Attorney Grant explained that the catering business would be part of the permits for the Inn. The Board member’s concern is that what she is trying to do is so complex and she is trying to start a business that hasn’t been approved by the Town Meeting as of yet. The Chairman addressed the timeline of Town meeting and the usual one year that the special permit would be for if granted. They would need the special permit for 18 month. The applicant’s intent is to try to get the proper permitting as quickly as possible. They are looking for temporary relief while this process is moving forward to be able to service her current catering customers. A Board member had a concern with the zoning requirement that the substitute change in use proposed be more compatible with the zoning requirement that the use be in characteristic of the surrounding area. He has a hard time seeing how a commercial catering kitchen is more compatible than the residential surrounding area. The applicant responded that the commercial kitchen currently existing was used more extensively on a day to day basis when it operated as a retirement home than the new use would be for. A Board member commented on the need for the length of the decision being 18 months or longer rather than the 1 year the Board usually grants for food establishments. Kim Woodward of 2030 Massachusetts Avenue is in support of an Inn but was confused with the wording “World Class Destination”. Wanted to make sure the character of the neighborhood wasn’t going to change with a large scale operation. She also had a major concern with traffic this would add to an already problem area. Ms Woodward asked the Chairman to clarify what this particular relief would be for and to confirm that it wasn’t for an open ended re-zoning from residential to commercial. Ursula Matulonis of 2045 Massachusetts Avenue shared the concern of the traffic problem. Would also appreciate some input from the applicant as to what they are going to be doing. Kevin Maguire of Slocum Road and also on Board of the Dana Home spoke in favor of the petition. Confirmed the use and operation of the Dana Home since 1916 as a retirement home with staff and with full kitchen services Colin Smith as President of Chamber of Commerce spoke to the requests the Chamber receives on a daily basis for information on lodging at an Inn. No one spoke in opposition to the petition. The Chairman asked what size vehicles would be used for the catering. The Chairman closed the hearing at 8:52 pm. BOA Meeting April 14, 2011 16 Three members of the Board was sympathetic to the house sitting vacant during the permitting process with Town Meeting and was in favor of granting the temporary use change. Two members of the Board were not comfortable putting a commercial use in a residential neighborhood before Town Meeting approval. One member felt that the by-law ordinance is encouraging non conforming use to get better or disappear; he did not see by granting this use how it would make the non conformity better. On a motion by Carolyn C. Wilson and seconded by Martha C. Wood, the Board voted 3-2 to grant a Special Permit in accordance with 135-28C and section 135-11 A2 to allow substitution of a non conforming use. This petition was denied. John J. McWeeney and Ralph D. Clifford were opposed to granting this request. The applicant is planning a second floor addition and to add two additions to the front of the property: 1) A proposed 60 sq ft porch and 2) A proposed 17 sq ft addition adjacent to the garage. A Board member asked if the wall on the left of the garage is moving. It is not. There were no audience questions. No one spoke in favor or in opposition to the petition.
