Geller; John J. Flynn; Sharon MacKenzie Health Department Attendees: Gerard F. Cody, Health Director; Ann Belliveau, Health Clerk/Office Manager Wendy Heiger - Bernays called the meeting to order at 7:00 p.m. The Board reviewed the minutes of May 11, 2011. MacKenzie motioned to accept the minutes with corrections. Heiger - Bernays seconded. All approved. Community Health Updates / Reports Community Health Report — Cody reviewed the Community Health Report prepared by David Neylon, R.N., and all follow -ups had been done in a timely manner. Cody elaborated about an active TB case. Environmental Health Update /Reports Environmental Health Report — The Board reviewed the Environmental Health Report prepared by Kathy Fox. State Sanitary Code Case Review — The Board reviewed the State Sanitary Code Case Review. a) Pool Variance Requests — Perlmutter motioned that the Lexington Board of Health grants the variance request from the requirement of lifeguards for the safe operation of pools as listed under 105 CMR 435.23 (1). In addition, all the requirements of 105 CMR 435.23 (2) shall be met including all signage which includes: "Warning No Lifeguard on Duty" in easy to read, legible letters which are at least four inches high "Children under age 16 should not use swimming pool without an adult in attendance" and another sign that states, "Adults should not swim alone ". This variance applies only to the following seasonal pool facilities, which have made the request in writing. They are listed as follows: Five Fields Pool Starwoods Hotel — Aloft and Element Pools This variance will expire at the end of the seasonal pool season or upon notification of an unsafe operating condition at a specific facility. Heiger - Bernays seconded. All approved. 108 Bow Street — Cody was advised by Barry Kutz, Electrical Inspector, of some electrical issues at 108 Bow Street. Cody was able to prepare an order to correct and all issues were corrected. 94 Hartwell — Cody explained that there has been a history at Waxy O'Connors of grease runoff into the wetland area. Order to correct letters were sent from both the Health Dept. and Conservation Dept. A plan has been approved by Conservation and now the grease may be cleaned up. 23 Shirle Street — Cody informed the Board of a condo unit offered for sub lease. The new tenant who rented the unit for her son and paid $1,650.00, contacted the Health Dept. and Police because of the unsanitary conditions of unit including drug paraphernalia. Cody said the Police not actively involved. Cody met the tenant at the property but the individual who rented the unit would not let them in for an inspection. Cody called the Police to be a witness. Cody and the tenant were never allowed in the unit. Cody will be sending a letter to the owner about the outside issues. 14 Hamblen Street — Cody inspected this property and the entire backyard looks like a landfill. There had been a pool in the backyard and this material dirt used to fill in the pool must have had broken glass and nails. A woman with two children had rented the house. Cody found are some electrical issues and chronic dampness in the basement. Cody will prepare order to correct letter. Old Res Swimming Beach Update — Cody reviewed the recent water sample tests conducted at the Old Res. He stated that the beach did not open until the water results were favorable. Cody informed the Board that out of 25 posters submitted, the Lexington Food Poster was accepted at the National Environmental Health Association Conference. Emergency Preparedness Report — Cody advised the Board that David Neylon, R.N., Public Health Nurse, has been working with the MRC to renew the CORI forms for 4A. • mailing was sent out to the members to be completed and returned for processing. • tabletop exercise has been approved in writing and the Carpathia Group has agreed to meet with a group from the MRC in August in the evening. MacKenzie motioned to delegate John J. Flynn, J.D., to represent the Board of Health at the CDM Preliminary Evaluation of a Source Separated Organics Facility at the Hartwell Avenue Landfill Site meetings. Heiger - Bernays seconded. All approved. Heiger - Bernays had received a call from a resident who was upset because of the poor hygiene displayed by the staff putting on a function at one of the middle schools. The Health Dept. had not received a temporary food permit application for this event which would have indicated the person -in- charge for the event. Cody will work with Mary Ellen Dunn to explain the process for future events. Noise Level at Shire — Cody advised the Board that the consultant for Shire have established the background levels based on testing over a several month period. The consultant will now need to continue testing to see if there is a violation but they must wait until Bldg. 200 at Patriot Way is completed and all units are up and running. Heiger - Bernays would like to have the consultant and Building Commissioner attend a future meeting. Flynn asked if the levels in violations of the Town noise bylaws and another concern is whether or not these levels are in fact a public nuisance. A discussion followed. MacKenzie motioned to adjourn. Flynn second. All approved.
