Commissioners present: Joyce Miller, Stew Kennedy, Dick Wolk, Angela Frick, Phil Hamilton,

Joyce Miller, Chair, opened the meeting at 7:30 p.m. in room G -15, Town Office Building.
7:30pm Plan Change: 125 Shade Street
Present for the applicant /homeowner: Edward Schadler homeowner
Mr. Schadler submitted plan and explained drainage issues on his property as well
as neighboring properties. He stated he had installed a catch basin in his yard and
would like to connect his catch basin to municipal storm water drainage system.
Administrator Mullins informed the commission that previous discussion with
Mr. Schadler indicated only springtime drainage would overflow into municipal
stone water drainage.
Comments from the commission to follow: David Langseth said he would like
some time to review plans submitted and asked that Mr. Schadler come back on
October 9"'.

Steve Erikson began by speaking to the Horns' concerns regarding water levels by
stating that Tutela Engineering had already addressed these issues in its original
review.
Administrator Mullins informed the commission that Tutela Engineering had
approved the plan and recommended the commission forward the Horns' question
to Peter Fletcher, the project soil scientist. Ms. Mullins also pointed out that the
plans showed a two -foot ground water separation level.
Doug Lees told the commission that he was present at original test pit digging,
and was also present at Peter Fletcher's test pit digging, and he stated that the
water table followed the ground slope. Attorney Bernstien felt that the same
questions had been raised, examined, and proven, again and again. Commissioner
Langseth asked Mr. Lees to make a sketch to help clarify issue.

Present for the applicant/ homeowner: Frank Kao, FKA Consultants
Wei Miao, homeowner /applicant
Frank Kao presents plan for second floor addition and deck. The project will take
place approximately 140 feet from brook.
Comments from the commission to follow: David Langseth asks for a description
of deck construction. Mr. Kao said the deck would be open, with composite
decking on sonotubes, and existing concrete underneath. Mr. Langseth wants
concrete under deck removed and replaced with gravel or crushed stone. Angela
Frick would like to see more protection along brook.
Motion made and seconded to issue negative determination with conditions, 7 -0
in favor.
8:05 p.m. Hearing 177 Grove Street, reopened

Doug Lees presented sketch and explained elevations /water elevations as it
related to location/depth of one infiltration system. Mr. Langseth questioned
infiltration systems location differing from test pits. Mr. Lees responded that most
test pits were very close to infiltration systems. Joyce Miller summarized a letter
received from Vita Hom, and one received from Fred Martin. David Langseth
asked if elevating grade would affect groundwater elevations. Steve Erikson and
Doug Lees both agreed that it would not.
Comments from the Audience to follow: Many of the members of the audience
shared the same concerns including;
• Test pits were dug in August during the dry season, instead of in the
spring when conditions were much wetter.
• Redirection of runoff, and an increase in the water table.
• Accuracy of test pits.
• Location of test pits differing from infiltration systems.
Conditions identified;
• Bond to guarantee waterproofing of basements will work.
• Soil investigation at location of infiltration system prior to installation of
infiltration system.

Susan Kahn explains problems with the supports under her back deck and the rear
section of her house, and needs to repair the footings.
Motion made and second to issue negative decision with conditions, 7 -0 in favor.
8:47 p.m. Hearing: 24 Saddle Club Road,

Present for the applicant /homeowner: Brian Timm, Meridian Associates
Brian Timm explained that a circular driveway had been constructed that was not
in compliance with the Order of Conditions. Mr. Timm proposed a drainage plan
to compensate for increase in impervious surface.
Comment from commission to follow: David Langseth was concerned driveway
runoff would not travel in the direction of infiltration system, and suggested
grating be installed in the driveway to capture runoff. Angela Frick and Stew
Kennedy were very concerned that the Order of Conditions had been disregarded.
Phil Hamilton stated he was against approving because the driveway was added
without the commissions' approval. Duke Bitsko was not comfortable that plan
would work as proposed and would like to see field conditions.
Motion made and seconded to continue hearing on October 9 at the applicant's
representative's request, to make technical changes, 5 -2 in favor.
9:05 p.m. Hearing: 440 Bedford Street,

Present for the applicant /owner: George Johannesen, Allied Engineering
Brian Timm, Meridian Associates
Hitesh Patel, Jamsan Hotel Management
George Johannesen presented a plan to demolish existing restaurant and build
larger restaurant, and strip and enlarge surrounding parking lot. Mr. Johannesen
informed the commission he had meet with Administrator Mullins, from it a new
plan had been submitted reflecting suggested changes including catch basins for
roof runoff and relocation of the new building to a position farther from the
wetlands. He also submitted details and a reply letter from DEP regarding the
Baysaver infiltration system proposed.
Comments from the commission follow: David Langseth said the flagged wetland
line could not be approved without a site visit with the environmental consultant.
Mr. Langseth asked what part of the parking lot drainage would be mitigated by
the new infiltration system. Mr. Langseth wanted revised plans and calculations to
show revisions. Joyce Miller would like to see improvement to the existing
drainage system used to mitigate the existing parking lot. Duke Bitsko felt the
Operation and Maintenance Plan was not adequate to protect wetlands ands
needed more specifics. He was concerned about if the owners will know how to

clean and maintain the new infiltration system. Joyce Miller wanted plans to
include snow storage locations. Dick Wolk would like to see existing parking lot
moved farther from wetlands.

applicant's representatives request, 7 -0 in favor.

Kevin Borselli responded to issues brought up at last meeting.
• Downspout outlets to wetland were tested and all are now disconnected.
• Debris has been removed from wetlands.
• Outlet pipe on the north side of property appears to have been overflow
pipe, but does not appear to be functioning.
Comments from the commission to follow: The Commission feels that because
the final outcome of the project from the Order of Conditions and approved plan
are so substantial, the project is not in Compliance. Applicant must apply for an
amendment to the current Order of Conditions to bring project into compliance.

discussing land acquisition and agreed not to reopen the meeting to the public.
