HomeMy WebLinkAbout2011-01-27-CPC-min Minutes of the Community Preservation Committee Thursday, January 27, 2011 7:00 pm Room 207 Town Offices Present: Board Members: Wendy Manz,Chair; Marilyn Fenollosa, Vice-Chair; Joel Adler, Norman Cohen, Jeanne Krieger, Leo McSweeney, Sandy Shaw, and Dick Wolk. Administrative Assistant : Nathalie Rice Also in attendance was David Kanter, member of the Capital Expenditures Committee (CEC) and Dawn McKenna, chair of Tourism Committee. The meeting was called to order at 7:00 pm by Ms. Manz. rdth 1.Approval of Minutes – Minutes from the meeting of December 23 and 30 were approved with changes, and minutes from an Executive Session from January 12, 2009 were approved as written. 2.Battle Green Master Implementation Plan Project – Ms. Manz noted the receipt of a cost breakdown submitted by Ms. McKenna. The document was an eight-page breakdown of the costs for the upcoming three years of the Battle Green Master Plan Implementation Project, and a summary of the work and associated costs for the restoration of the monuments. (The monument project is proposed by David. Pinsonnealt, Manager of Operations for DPW.) Mr. Adler questioned some of the work associated with the restoration of the Hayes Fountain, and Ms. Fenollosa noted that there were aspects of the details that might need further review prior to CPC approval (e.g., repairing and painting of fences). Mr. Kanter stated that it made sense from the standpoint of project definition, to add the $11,000 cost of the restoration of the Hayes Fountain to Mr. Pinsonneault’s project, since this work was monument restoration work. He suggested that the Monument Restoration project be increased from $50,000 to $65,000 and that the Battle Green Master Plan Implementation Project be decreased to $35,000. This discussion was continued after the Public Hearing, (please see below). 3.LexHAB Request for Set-Aside Funds – Ms. Manz reviewed the near final draft of the Guidelines for LexHAB’s project, and changes were made to 1 items 7 and 10 in the document. Ms. Rice will incorporate the changes and send out a final copy to the Committee. 4.Muzzey High Condominium Owners’ Window Replacement Project – Ms. Manz updated the Committee on recent progress regarding this project. She explained that an estimate had been received from Town Counsel outlining the legal costs for the project, which were conservatively in the range of $15,000 depending upon the number of people who signed on for Town assistance. She noted that the unit owners would have to sign a promissory note, which would be recorded with a mortgage at the Massachusetts Registry of Deeds, which would fix a lien on each property. Upon sale an individual unit, that note would come due, and the Town would be paid the amount of the loan for the window installation. There would be no interest on the loan. Ms. Manz reported that Ginger McGuire, representative for the Condominium Association, had contacted the 35 unit owners. Seven had responded that they were willing to sign such notes, while five had responded that they would not. Ms. Manz added details of her follow-up discussion with Town Counsel, and noted that there were some legal costs which would be difficult to estimate. The Committee voted 8-0 to add $20,000 to the project cost to cover legal fees. The Committee voted 8-0 to hold the CPC meeting open until after the upcoming public hearing on the Needs Assessment Report. The CPC meeting was temporarily adjourned at 7:25 pm, and members moved to Cary Hall for the public hearing. The meeting was subsequently reconvened at 9:10 pm. Mr. Wolk was not present for this part of the CPC meeting. 5.Additional Discussion of Battle Green Master Plan Implementation Project – There was continued discussion with Ms. McKenna on the two Battle Green projects, in which Mr. Kanter stressed the importance of changing the two project amounts. It was noted, however, that without the project proponent’s permission, in this case Mr. Pinsonneault, the Battle Green Monument Restoration application could not be amended. The Committee decided to keep the projects as submitted; $50,000 for the Battle Green Master Plan Implementation, and $50,000 for the Battle Green Monument Restoration. These amounts will be carried in the warrant, which st was due to be finalized on January 31. The Committee will have further discussion at the next meeting regarding the scope of the work on the 2 implementation plan after they have reviewed the new data from Ms. McKenna. rd The CPC agreed to meet on February 3 at 3:00 pm.
