HomeMy WebLinkAbout2011-07-12 CONCOM-min MINUTES – LEXINGTON CONSERVATION COMMISSION July 12, 2011 Commissioners present: Joyce Miller, Stew Kennedy, Charlie Wyman, Duke Bitsko, Dick Wolk, David Langseth (8:35) Commissioners Absent: Phil Hamilton, Others present: Karen Mullins, Conservation Administrator; Louise Vinci, Conservation Clerk Chair Joyce Miller opened the meeting at 7:30 pm in Room G-15, Town Office Building 7:30 pm Hearing: NOI, 9 Phillip Road, DEP# 201- 825, BL 783 Present for the applicant: Mark Pamarini, Hamway Engineering Greg Shrader, Architect Documentation: Notice of Intent with attachments Public Notice Mark Pamarini presented a plan to construct an addition to a school building. The proposed addition would be constructed outside of jurisdiction but associated work including reconstructed sidewalks, 5 light posts, upgraded utilities and utility lines would occur within 100 feet of bordering vegetated wetlands. Comments from the Commission follow: Stew Kennedy questioned where stockpile would be kept. Mr. Pamarini responded that it would be kept in the parking lot outside of the one hundred foot buffer area and trucked out daily. The Commission noted that they were not approving wetland line as part of this project. Motion made and seconded to close hearing, 6-0 in favor. 7:40 pm Meeting: RDA, Arlington Reservoir, DET# 11-19 Present for the applicant: Chuck Toroni, Arlington Conservation Commission David White, Town of Arlington Documentation: Request for Determination of Applicability with attachments Public Notice Mr. Torini presented a plan to harvest 6-8 acres of water chestnuts from the Arlington Reservoir. During discussions Mr. Torini confirmed that no land activities would occur in Lexington. Mr. Torini explained that past harvesting had a 100% success rate but during a two-year lapse in harvesting water chestnut had grown back. Motion made and seconded to issue a negative determination with condition, 6-0 in favor. Sarah Nardella, applicant Documentation: Request for Determination of Applicability with attachments Public Notice Ken Elsner presented a plan to remove and replace four trees and install new pool equipment. Comments from the Commission follow: David Langseth asked if any work would take place that was not outlined within the application. Mr. Elsner replied that the pool deck would be replaced. The Commission suggested the applicant amend the application to include all additional work intended. Motion made and seconded to continue to July 26, 2011 at the applicant’s request, 6-0 in favor. 8:00 pm Meeting: RDA, 411 Concord Avenue, DET# 11- 18; Map 10, Lot 37C Present for the applicant: Wendy Krumb Documentation: Request for Determination of Applicability with attachments Public Notice Wendy Krumb presented a plan to remove and replace a portico and steps. Comments from the Commission follow: the Commission would like to condition that erosion control be put in place. Commission noted that they were not approving wetland line as part of this project. Motion made and seconded to issue a negative determination with conditions, 6-0 in favor. 8:07 pm Meeting: RDA, 92 & 100 Hayden Avenue, DET# 11-20; Map 18, Lot 4A Present for the applicant: Dominic Rinaldi, Documentation: Request for Determination of Applicability with attachments Public Notice Mr. Kennedy recused himself from meeting due to a financial interest in Boston Properties. Mr. Rinaldi presented a plan to improve parking lot. Comments from the Commission follow: The Commission asked about possible invasive species management in the detention basin. Mr. Rinaldi responded that as the phragmites within the basin were Page 2 of 5 MINUTES – LEXINGTON CONSERVATION COMMMISSION MEETING July 12, 2011 sporadic, he felt that removing them might do more harm than good. The Commission would like photos sent to the Commission to document current conditions and future growth. The Commission inquired if new curbing was proposed and, if it was, if erosion controls were proposed. Mr. Rinaldi responded that new curbs were proposed and erosion controls were in place. Motion made and seconded to issue a negative determination with conditions, 6-0 in favor. 8:18 pm Hearing: NOI, 10 Holton Road, DEP# 201-827, BL 785, Map 59, Lot 71 Present for the applicant: Fred Russell, Engineer Roger Kaniard, applicant Documentation: Notice of Intent with attachments Proposed Site Plan, revised July 7, 2011 Town Engineering Comments Public Notice Fred Russell presented project and submitted revised plans. Revisions included foundation drains, stone trenches at outlets and the removal of nine trees. Joyce Miller read town engineering report into record. Comments from the Commission follow: The Commission was concerned that the applicant was proposing the removal of nine trees and discussed how the wetland could be impacted. The Commission questioned if a peer review would be needed and would like a meeting with a certified arborist on site. The Commission was also concerned about the walkout basement and encroachment on the slope, further clearing and safety hazards. The Commission requested the submission of a landscaping plan. Motion made and seconded to continue hearing to July 26, 2011 at the applicant’s request, 5-0 in favor. 8:45 pm Hearing: NOI, 25 Robinson Road, DEP# 201-xxx, BL xxx; Map 83, Lot 29A Present for the applicant: Kevin Fleming, Cyprus Design, Inc. Documentation: Documentation: Notice of Intent with attachments Town Engineering Comments Public Notice Kevin Fleming presented a plan to raze and rebuild a single-family dwelling. Comments from the Commission follow: David Langseth would like documentation submitted comparing impervious surfaces existing and proposed. Dick Wolk questioned if the driveway turnaround could be moved further from the wetland. Duke Bitsko felt that a test pit was need at the location of the infiltration system. Stew Kennedy felt the two trees discussed were significant and was concerned about their removal. Stew Kennedy would like to see mitigation to improve the resource area. Motion made and seconded to continue hearing to July 26, 2011 at the applicant’s request, 6-0 in favor. 9:10 pm Hearing: NOI, 3 Forbes Road, DEP# 201-826, BL 784; Map 43, Lot 9D Present for the applicant: Robert Gemma, Metro West Engineering Documentation: Notice of Intent with attachments Town Engineering Comments Public Notice Robert Gemma presented a plan to build a single story parking deck within existing parking lot. Mr. Gemma noted that excavated materials would be removed at time of excavation. Comments from the Commission follow: David Langseth would like silt sacks at catch basins, orange construction fencing along perimeter of parking lot and hay bails on site in case needed. The Commission would like alternative analysis submitted. Duke Bitsko asked about lighting plan. Mr. Gamma responded that no light would be cast beyond structure. Motion made and seconded to close hearing, 6-0 in favor. 9:21 pm Re-opened Hearing: NOI, 359 Lincoln Street, DEP# 201-504, BL 462; Map 34, Lot 113 Present for the applicant: Fred Conroy, applicant Patricia Davidson, Attorney Dennis Lowry, Wetland Consultant John Noonan, Engineer Attorney Patricia Davidson went over need to re-open hearing due to remanding back to the Commission by Appellate Court. The Commission was concerned that no information was submitted to them prior to hearing since it is a new hearing and at least one of the Commissioners was not present during previous proceedings. Discussions followed between Attorney Davidson and the Commission regarding the purpose of the hearing and process for the Commission. After discussion it was determined that one complete copy of previous proceedings would be submitted as well as relevant documents for Commissioners review. In addition, Attorney Davidson provided a letter for the record from Dennis Lowery responding to the forested buffer findings by the Commission in previous decision. Issue Order of Conditions: Minuteman Bikeway, DEP# 201-818, BL 776 Motion made and seconded to issue Order of Conditions, 4-0 in favor. David Langseth and Charlie Wyman did not vote because they did not participate in all hearings. Issue Order of Conditions: Sorrell Road, Burlington, DEP# 201-809, BL 766 Motion made and seconded to issue Order of Conditions, 4-0 in favor. David Langseth did not vote because he did not participate in all hearings, Charlie Wyman recused himself. Confirm Certificate of Compliance: Ryder Lane, DEP# 201-045 Motion made and seconded to confirm Certificate of Compliance was issued November 5, 1987, 6-0 in favor.
