MINUTES – LEXINGTON CONSERVATION COMMISSION June 21, 2011

Comments from the Commission follow: Stew Kennedy questioned erosion
control at the end of the wall. Mr. Houlihan responded that a boulder 3-4 feet in
diameter would be used. The Commission wanted mowing ceased within the
twenty-five foot wetland buffer.
Motion made and seconded to issue a negative determination with conditions, 4-0
in favor.

Gary Larson presented plan. Scott Smyers presented wetland line and revisions
and described methodology and rationale used to determine wetland boundary.
Comments from the audience follow: Member of the audience had concerns about
the process by which the wetland boundary was determined, how it was reviewed,
if and how it could change, and how any proposed project resulting from the
determined wetland boundary could impact the wetland and surrounding areas.
Comments from the Commission follow: Duke Bitsko went over the processes the
Commission used to determine the wetland boundary.

Mike Carter outlined proposed revisions:
Maple Street – change shallow swale to vegetated swale.
Revere Street – west side of Revere Street and north side of bikeway
swale to remain armored versus changing to vegetated swale due to water
velocities. Swales to the southwest and north east side of Revere Street
will be planted with New England wetland seed mix and plugs.

Comments from the Commission follow: The Commission would like a condition
to require by-pass pumping at sump pump discharge from 22 Revere Street to
allow plantings to become established. Duke Bitsko would like erosion control
matting used in swales to be planted. The Commission was concerned about
swales designed with vegetation over stone and would like a two year planting
guarantee. If plants do not survive they will need to be replanted.

Letters of support
The Commission discussed evidence provided to determine if land fit within the
parameters of agricultural use as outlined under the agricultural exemption. The
Commission noted that the applicant was encroaching on conservation land and
would like the applicant’s fence moved off of town property.
Motion made and seconded to issue a negative determination finding that
proposal was exempt pursuant to agricultural definition, 4-0 in favor.

Charlie Wyman recused himself from the hearing and left the room.
Joyce Miller read public notice and re-opened hearing continued to a date
uncertain in November 2010.
Scott Morrison gave an overview of the proposed project, responded to
engineering review comments, submitted soil test information and presented
rationale for wetlands delineation.
Attorney Cooper summarized and submitted a report of his findings after a review
of conservation permit records.

Present for the applicant: David Sperduto
Motion made and seconded to re-open hearing, 5-0 in favor.
David Sperduto submitted soil logs and revisions to plan as well as test pit results.
Mr. Sperduto felt that infiltration could not be installed due to high ground water.
The Commission had the following concerns and suggestions:
The commission was concerned that the stone barrier was proposed so
close to the wetland and no restoration buffer was proposed.
The Commission felt that other options for infiltration should be explored.
The Commission would like foundation examined by a structural engineer.
The Commission would like the applicant to explore moving the deck
further from the wetland.
Motion made and seconded to continue hearing to July 12, 2011 at the applicant’s
request, 5-0 in favor.
10:38 pm Willard’s Woods issues
Joyce Miller updated commissioners on concerns brought forward by Susan
Hilzenrath after an incident occurring when a dog entered her property from
Willard’s Woods.

Commissioners felt if Ms. Hilzenrath may want to block the path leading to her
house from Willard’s Woods and suggested putting up a fence.
