Lexington Board of Health Meeting, April 13, 2011 at 7:00 p.m.

Sharon MacKenzie called the meeting to order at 7:00 p.m.
The Board reviewed the minutes of March 9, 2011. Perlmutter motioned to accept the
minutes as written. Geller seconded. All approved.
Community Health Updates / Reports
Community Health Report – The reviewed the Community Health Report prepared by
David Neylon, R.N., and all follow-ups had been done in a timely manner.
Environmental Health Update/Reports
Environmental Health Report – The Board reviewed the Environmental Health Report
prepared by Kathy Fox.
State Sanitary Code Case Review – The Board reviewed the State Sanitary Code Case
Review.
a)Sizzling House of Kebab – New Establishment
Cody advised the Board that Farhad “Fred” Salemi, Owner of Sizzling House of
Kebab has completed a food plan review with the Health Division. All necessary
equipment has been installed according to code. Mr. Salemi appeared before the
Board to request a permit to operate a food establishment. After a discussion,
Flynn motioned that the Lexington Board of Health grants an annual permit to
operate a food establishment to Sizzling House of Kebab located at 321 Woburn
Street. Perlmutter seconded. All approved.
b)94 Hartwell Avenue – Waxy O’Connors Update
Cody informed the Board of a recent oil spill outside of Waxy O’Connors which
was discovered by Health Agent Fox during a routine inspection. Fox alerted
Karen Mullins, Conservation Director of the spill because of the environmentally
sensitive area surrounding this building who alerted Cody. Animal oil and
vegetable oil (fats, grease and non petroleum oils) are listed under hazardous
materials according to the Massachusetts Contingency Plan. Quantities of fifty-
five (55) gallons or more that are released or spilled into the environment are
required to be reported to the Mass Dept. of Environment Protection. Cody
prepared an order to correct letter.
c)Water Testing Project Update

Cody advised the Board that on April 1, he drove a BU School of Public Health
student and Wendy Heiger-Bernays to every school for an upcoming water testing
ndst
project to be conducted on April 2. This exercise on April 1 was to establish
where water samples would be drawn for lead testing. In November, the Fiske
School tested positive so the faucet was removed. At least four samples will be
taken at each school at various locations. Cody said results should be available
with a week.
d)State Sanitary Code Program – 847 Mass Avenue
Cody explained that a cross-metering complaint was received on March 17, 2011
from a new tenant at this address. Both the Plumbing & Gas Inspector and
Electrical Inspector conducted an inspection in the basement and second floor and
felt there were some issues but they would need access to the first floor unit.
Permission from the first floor tenant to enter their unit is needed. A more

thorough inspection for both units will be conducted on May 5 to determine any
cross connection issues.
e)Tobacco Compliance Program
Cody informed the Board that the Town of Lexington was awarded a mini-grant
through the MHOA. Bedford, Winchester and Lexington will be working
together by using the same inspector for compliance checks.
f)Mosquito Control Program Update
Cody advised the Board that the annual helicopter application of Bti is tentatively

being schedule for either April 14 or 15.
Emergency Preparedness Report – Table Top Exercise Update - Cody informed the
Board that the Table Top Exercise will most likely take place on May 3 but he is waiting
to hear from MDPH on final approval on appropriate use of EP funding.
Perlmutter motioned to adjourn. Flynn second. All approved.
