Lexington Board of Health Meeting, March 9, 2011 at 7:00 p.m.

Heiger-Bernays called the meeting to order at 7:00 p.m.
The Board reviewed the minutes of February 9, 2011. MacKenzie motioned to accept the
minutes as written. Perlmutter seconded. All approved.
Environmental Health Report
Bruce Haskell of CDM Consultants, and Robert Beaudoin, Superintendent of
Environmental Services for the Town gave an informational presentation to the Board
concerning a proposed organic waste facility at 60 Hartwell Avenue. Haskell also
explained the Board of Health’s role for this project would be to determine that the
proposed site and facility meet specific site criteria. Haskell explained that the 60
Hartwell Avenue site would accept between 40-50,000 tons per year of source separated
food waste (200-250 tons per day) and the project would be developed on land leased to
private entity. Haskell also mentioned that the Board of Health would need to
demonstrate that the site is protective of human health, safety and the environment. A
discussion followed. Heiger-Bernays asked that the Board of Health be informed the
entire way.
Entironmental Health
Wilson Farm Request for a Variance to use Time as a Public Health Control - Cody
advised the Board of Wilsons request for a variance to use time only as a public health
control for the following items:
Mini Carrots Coleslaw Cut Butternut Squash
Cut Hubbard Squash Cut Cabbage Califlower Fleurettes
Pasteurized Cider
After a discussion, MacKenzie motioned that a variance may be granted under time as a
public health control. It would allow specific foods listed in the variance request to be
out of temperature for up to 4 hours. Any foods that have met or exceeded the 4 hour
limit must be discarded. The time the food goes out is logged at Wilsons and available
for the Health Inspector. Geller seconded. All approved.
Formosa Taipei - Steven Cao of Formosa Taipei appeared before the Board because a
recent inspection revealed some violations which needed to be corrected.
Fox conducted a reinspection and discovered the violations had not been corrected in a
timely manner. Cody advised the Board that a food consultant has been working with the
staff at Formosa Taipei on a monthly basis. Cao also informed the Board that effective
March 21, 2011, there is a new PIC who is the Chef.
Community Health Report – The reviewed the Community Health Report prepared by
David Neylon, R.N., and all follow-ups had been done in a timely manner.
Environmental Health Report – The Board reviewed the Environmental Health Report
prepared by Kathy Fox.
State Sanitary Code Case Review – The Board reviewed the State Sanitary Code Case
Review.
Cody distributed an update concerning dog waste notes since the informational
presentation at the Board of Health meeting last month. Cody also advised the Board that
the barrels at Williards Woods get emptied daily from March through November and
twice a week from December through February. Heiger-Bernays asked Cody to follow
up to make sure the barrels are being emptied according to the schedule. Cody informed
the Board that the Stephanie Doucette, ACO advised him that there is usually 10-15 piles
of dog waste per day. Sue and Steve Hilzenrath of 17 Suzanne Road expressed their
concerns to the Board relative to the uncovered unemptied barrels at the entrance to
Willards Woods and the amount of dog waste in the area. The Hilzenrath’s would like to
see the Board of Health work with Conservation concerning enforcement, regulation,
information, education, fines and signage. Perlmutter suggested having the regulation
posted and, perhaps, Conservation could have a Police Officer present for a day. The
Board also discussed that dog waste problem throughout the Town. The Board asked
Cody to find out about the formation of a subcommittee with representation from
Conservation to deal with maintenance of dog waste issues.
Perlmutter motioned to adjourn. MacKenzie seconded. All approved.
