MINUTES – LEXINGTON CONSERVATION COMMMISSION April 19, 2011
Commissioners present: Joyce Miller, Stew Kennedy, Phil Hamilton, David Langseth
Commissioners absent: Duke Bitsko, Charlie Wyman, Dick Wolk
Others present: Karen Mullins, Conservation Administrator; Louise Vinci, Conservation Clerk
Chair Joyce Miller opened the meeting at 7:40 pm in Room G-15, Town Office Building
7:40 pm Hearing: NOI, Hastings Elementary School,
DEP# 201-817, BL 775, Map 51, Lot 45A
Present for the applicant: Thomas Marge, Boy Scout Troop 160
Documentation: Notice of Intent with attachments
Thomas Marge presented a plan to maintain a trail and construct a footbridge
across wetlands.
Comments from the Commission follows: David Langseth was concerned about
proposed trail re-alignment and felt that trail location should not be altered. Stew
Kennedy questioned where materials would be delivered and cut. Mr. Marge
responded that materials would be delivered and cut in the school parking lot.
Motion made and seconded to close hearing, 4-0 in favor.
Issue Order of Conditions: Hastings Elementary School,
DEP# 201-817, BL 775, Map 51, Lot 45A
Motion made and seconded to issue Order of Conditions, 4-0 in favor.
7:50 pm Request to Issue Certificate of Compliance: 10 Hawthorn Road,
DEP# 201-785, BL 745, Map 77, Lot 12
Present for the applicant: Peter Daus-Haberle, Architect
Mr. Daus-Haberle explained that the deck had been built two feet closer to the
wetland than approved and more infiltration than proposed was installed.
Comments from the Commission follow: The Commission felt the portion of the
deck not in compliance with the Order of Conditions would need to be removed
before a Certificate of Compliance could be issued.

Motion made and seconded to continue hearing to May 10, 2011 at the applicants
request, 6-0 in favor.

A representative for the applicant’s tree service came before the Commission
regarding the removal of three trees. The proposal consisted of parking a crane in
the driveway. Cutting trees down with a chainsaw and lifting them over the house
by crane. Stumps would not be ground down no equipment would enter the back
yard.
The Commission agreed to approve tree removal as proposed.

Motion made and seconded to issue Order of Conditions, 4-0 in favor.
Issue Order of Conditions: 14 Woodpark Circle,
DEP# 201-816, BL 774; Map 59, Lot 192
Motion made and seconded to issue Order of Conditions, 4-0 in favor.
8:07 pm Appoint representatives to Land Management Subcommittee,
Phil Hamilton explained the representatives’ roles would be to serve as an
advisory committee to the subcommittee and provide input and feedback related to
issues at Willard’s Woods. Four to five people would be appointed to represent the
interested parties.
8:20 pm Ratify Enforcement Order: 94 Hartwell Avenue,
Motion made and seconded to ratify Enforcement Order, 4-0 in favor.
8:27 pm Cotton Farm Land Management Plan draft review,
The Commission discussed the parking location, mowing the apple orchard, signs
along the property borders and the installation of bounds.
Motion made and seconded to approve as amended, 4-0 in favor.
