MINUTES – LEXINGTON CONSERVATION COMMMISSION April 5, 2011
Commissioners present: Joyce Miller (8:00 pm), Stew Kennedy, Phil Hamilton, Duke Bitsko,

Vice-chair Phil Hamilton opened the meeting at 7:30 pm in Room G-15, Town Office Building

Present for the applicant: Margaret Read-Weiss, Land Steward
Documentation: Request for Determination of Applicability with attachments
Margaret Read-Weiss presented a plan to remove invasive garlic mustard and
Japanese Knot weed. The plan included using goats on Juniper Hill and hand
removal at 35 and 37 Barberry Road.
The Commission would like the following conditions attached to the permit.
Disturbed areas must be restored and plantings approved in advance by the
conservation staff.
The use of goats is limited to a one month window.
Bag and dispose of plants in an incinerator.
Motion made and seconded to issue a negative determination with conditions, 6-0
in favor.

Documentation: Request for Determination of Applicability with attachments
Keith Ohmart presented a plan to remove two medium sized trees that overhang
the roof of the shed that housed the pump system for the Cotton Farm so the shed
can be reroofed. Reroof the shed and add a small roofed lean-to onto the south
side of the shed for dry storage of small amounts of trail project lumber. Remove
the old fence that defined the western edge of the Cotton Farm property and that
separated it from the adjacent conservation land. Remove the arbor and dock
structure from the pond edge. Build a 32' trestle bridge to span the Vine Brook
tributary where the existing path crosses it.
The Commission had the following concerns and conditions: The fence post
should be cut at ground level or post holes should be filled using clean soil.
Trestle bridge piers should be constructed of plastic lumber. If trail is re-routed
the applicant will need to reappear before the Commission for permission and a

Notice of Intent maybe needed. The storage of gas products and equipment in the
shed is not allowed. The Commission is not in favor of changes to the roof line.
Vehicular access to the shed must be limited.
Motion made and seconded to issue a negative determination with conditions, 7-
0 in favor.

Fred Russell presented plan revisions which included: wetland delineation, trees
identified on plan, redesigned drainage detail, soil testing, and went over
alternative plan submitted at meeting.
Duke Bitsko updated the Commission on the site visit.
Motion made and seconded to close the hearing, 7-0 in favor.

Riverfront Alternative Analysis, dated March 16, 2011 (received at meeting)
Joyce Miller read public notice and town engineering comments into record.
David Craver presented an overview of the project which included the removal of
a breezeway to be replaced by a two story addition, the construction of a screened
in porch, and removal and replacement of a deck. David Sperduto presented
wetland methodology and rationale. Al Gala presented soil test results and
infiltration details. Chip Webster presented building alternative analysis.
Comments from the Commission follow: David Langseth was concerned that
calculations for the project did not comply with pre-development standard 5(6) of
the bylaw regulations. Charlie Wyman raised concerns about non-compliance
with setback performance standards. Joyce Miller questioned if the two story
addition would have a full basement. Duke Bitsko requested clarification

regarding planting mitigation. David Langseth requested details regarding for
sump pump discharge.
Motion made and seconded to continue hearing to May 10, 2011 at the request of
the applicant, 7-0 in favor.
The Commission felt that the trees the applicant requested to remove could be a
safety hazard. The commission would like a representative from the tree removal
company to appear before them and discuss conditions of approval including: A
crane to remove trees by lifting over the house from the driveway, and stumps left
in place.
Motion made and seconded to approve, 7-0 in favor.

Joyce Miller read public notice and town engineering comments into record.
Richard Kirby presented a plan to remove a deck and build an addition in its
place.
Comments from the Commission follow: Phil Hamilton questioned if existing
concrete pad would remain when deck was removed. Mr. Kirby said it would.
Charlie Wyman asked how the land would become naturalized. Mr. Kirby
responded that existing wetland species would migrate over time.
Motion made and seconded to close hearing, 7-0 in favor.
