HomeMy WebLinkAbout2010-11-04-TREE-article xx tree bylaw Article xx Tree By-law (Place holder) To see if the Town will vote to amend the Tree By-law by: - removing section 120-4.B of the bylaw that currently excludes sites under other jurisdictions - for larger sites, providing for a larger fraction of the site protected by the bylaw. DESCRIPTION: Sites under the jurisdiction of the Planning Board, Conservation Commission and the Zoning Board of Appeals are currently excluding from the Tree Bylaw. This change would remove that exclusion. The current bylaw applies only to the setback areas (30 ft in front, 15 feet for the sides and back). For single family residential sites this makes sense. However, for large residential or commercial developments, a much smaller fraction of the site is covered (The larger the site the smaller the fraction of the site to which the bylaw applies). Consider, for example: 100' x 100' site: 61% covered by the bylaw: 200' x 200' site: 34% 400' x 400' site: 18% The change will correct this inequity by increasing the fraction of the site covered for larger sites.
