HomeMy WebLinkAbout2010-05-25 CONCOM-minMINUTES — LEXINGTON CONSERVATION COMMMIS SION May 25, 2010 Commissioners present: Joyce Miller, Charles Wyman, Phil Hamilton, Stew Kennedy, David Langseth, Duke B itsko Absent: Dick Wolk [ethers present: Karen Mullins, Conservation Administrator; Louise Vinci, Conservation Clerk Joyce Miller opened the meeting at 7:00 pm in Cary Auditorium of the Cary Memorial Building. 7:00 pm Land Management Subcommittee Report on Willard's Woods Joyce Miller 'Informed the audience that the Land Management Subcommittee Report and the Ecological Impact Report would be available in the conservation office and on the town website in the morning. Charlie Wyman presented the Land Management Subcommittee report. The report included: • Recent history S How the subcommittee went about it's work e The core issues • What was learned Conclusions +� Recommendations o Option 1 — Separation by time o Option 2 — Separation by space o Option 3 — A hybrid of the first two options Comments from the commission follow: Stew Kennedy congratulated the OP subcommittee on their good work, Mr. Kennedy was interested in exploring the possibility of a dog park elsewhere in town, felt that the North Street parking lot needed attention, liked the idea that dogs on leash would be permitted on conservation land at all times, and felt that the regulation related to dog owners having immediate restraint and control of their off-lease dogs was unclear and would be in favor of a better definition town wide, Phil Hamilton asked in regards to option 2 and 3 of the reports recommendations, what criteria was used for determining zones on/off leash and times on/off leash. Mr. Wyman responded that zones were determined by easily defined boundaries, the sensitivity of the area, and the relation of zones to abutting houses. David Langseth was not in agreement that the definition of immediate restraint and control was unclear. Mr. Langseth was in favor of regulating off -leash dogs by separation of time vs. space and a division of days vs, hours. Mr. Langseth was also in favor of an incremental fee added to dog licenses that could go into a fund used for trash barrels, signage and Page 1 of 4 MINUTES —LEXINGTON CONSERVATION COMMMISSION MEETING May 25, 2410 other dog related needs in Willard's Woods. Mr. Langseth was also in favor of requiring a special permit for professional dog walkers. Duke Bitsko told the commission that the sub - committee had examined ways to segregate the trails for off leash dogs and could not find one that would work. Mr. Bitsko said the sub - conlamWee did not want to promote internal signs. Comments from the audience follow: Sue Hilzenrath of 17 Suzanne Road commented on the process and the improved communication between the groups on either side of these issues and wanted to encourage continuing both. Bernie Gunther of 26 Brent Road felt that the commission should speak with people who no longer visit Willard's Woods. Nancy Bryant of 56 Blossomcrest Road questioned when the biological and the sub - committees reports would be available and when the public hearing would be held. Joyce Miller told Ms. Bryant that the reports would be posted to the town website in the morning and a public hearing would be held on June 7, 2010. 8:00 pm Meeting Conservation Land at corner of Massachusetts Avenue and Woodberr Road, DEN 10- 11; Map 57, Lot 214A Present for the applicant: Jean Williams, applicant Jinn Williams, applicant Jim Williams presented a plan to remove invasive plant species on Conservation Land along the periphery of wetlands. Work done along the wetland boundary would be done by hand. Comments from the commission follow; Duke Bitsko asked about plant removal. Mr. Williams explained that with the exception of garlic mustard wetland plants would be left upland on site, Mr, Williams was concerned about erosion control along the banks slope and asked for the commission's guidance. Mr. Bitsko identified that a native seed mix and weed free straw or an erosion control mat could be use. Motion made and seconded to issue a negative determination with conditions, 6 -0 in favor. 8:10 pm Hearin: Dunback Meadow DEN 201 -791, BL 751 Present for the applicant: Emily Schadler, applicant Emily Schadler described the mowing and trail maintenance management plan, which included maintaining currently existing trails and manual treatment of areas along trail and meadows where invasive species occur. Comments from the commission follow: Duke Bitsko asked about mowing equipment to be used and setting the mower blade high for wildlife safety purposes. Motion made and seconded to close hearing, 6 -0 in favor. 8:20 pm Hearing: 95 Woburn Street, DEN 201790, BL 750: Map 47, Lot 24 Present for the applicant: Mary Trudeau, Representative If Mary Trudeau submitted a soil report and presented a plan to construct an addition to a single - family dwelling, install an infiltration system and replace an existing impervious driveway with a driveway constructed with pervious pavers within the fifty -foot buffer zone to bordering vegetated wetlands, Comments from the commission follow: David Langseth was concerned about proposed landscaping along the eastern property boundary and saving the existing plant species. Duke Bitsko requested a detail of the construction of the permeable driveway be submitted. Phil Hamilton felt that because all runoff from the new dwelling would be infiltrated the proposed would be a major improvement over existing conditions and justifies permitting the posed structure inside of the fifty- foot buffer to wetlands. David Langseth read engineering report into record. Issue order of Conditions: 100 Woburn Street DEN 201-787, BL 747; Map 47, Lot 39A Motion made and seconded to issue an order of Conditions denying the proposed construction of the single - family dwelling at 100 Woburn Street due to the steep topography to the Bordering Vegetated wetlands surrounding the dwelling on three sides, resulting in a higher likelihood of adverse impacts to the wetlands than if the topography was not as steep, both during and after construction, from erosion and residential activity encroachment associated with the dwelling, creating a need to have a buffer zone larger than the minimum value of 50 feet for structures and greater than 25 feet for site development and landscaping, 6 -0 in favor.
