Geller Health Department Attendees: Gerard F. Cody, Health Director; Ann Belliveau, Health Clerk Heiger- Bernays called the meeting to order at 7 :00 p.m. Community Health Report — The Board reviewed the Community Health Report and all follow -ups had been done in a timely manner. Environmental„ Health Report Shade Street Noise Complaint — Information Presentation - Cody introduced Richard Canale of 29 Shade Street to the Board. Canale distributed to the Board copies of Mr. Canale addressed the Board of Health because he is concerned about noise eminating from Shire. Canale stated he was representing himself but other residents on Shade Street are concerned about the noise emanating from Shire. Nicole Ciccolo of 50 Shade Street also advised the Board about the noise emanating from Shire even into her backyard and the high pitch tonal noise wakes her up during the night. A discussion followed. Canale also mentioned that a Shire consultant report had been submitted to the Building Commissioner and the Building Commissioner will issue an RFP for a peer review to determine whether to agree or disagree with the Shire consultant report. Heiger- Bernays said the next step should be in touch with the Building Commissioner to get the answers needed as to what measure is the appropriate measure in looking at the noise bylaw. Heiger- Bernays said the Board needs to know what are the right metrics and what is the interpretation and what will this facility and others be held to. Environmental Health Report Formosa Taipei — Maureen Lee introduced Brandon Lee representing Formosa Taipei. Lee updated the Board as of 6125110. Lee stated some improvements have been made but additional work is needed. As a result, the owner of Formosa Taipei has asked Lee to stay on for an additional period of time. RUYI — henry Cheng, Manager of RUYI appeared before the Board of Health to have the Board approve the annual food permit and have the Board approve the HACCP Plan for the production of sushi rice. After a discussion, Heiger- Bernays motioned that the Lexington Board of Health has agreed to issue a food permit to operate RUYI at 27 Waltham Street. It is anticipated that compliance will be achieved with the Food Code. Be aware that failure to comply with the food code may result in certain corrective actions including but not limited to you hiring a food consultant to provide your staff with training or closure of your establishment due to serious and repeated violations of the Food Code. Perlmutter seconded. All approved. Perlmutter motioned that the Lexington Board of Health grants the variance as outlined in Food Code 3- 502.1 for the acidification of rice intended to prepare sushi products. RUYI is required to follow the plan as submitted to this office, including but not limited to, maintaining accurate testing records for the rice, maintaining a calibrated pH testing instrument and purchasing sushi grade products from approved sources. Failure to follow this HACCP plan may result in the termination of this variance and RU YI's ability to serve sushi products. Geller seconded. All approved. Caulk Testing pdate ---- The Board reviewed the Caulk testing update prepared by Cody dated July 14, 2010. Air sampling is to begin at the three locations next week. A remediation plan will be developed for submittal to the EPA once the air sampling data has been obtained. Housing Updates 12 Calvin Street — Cody updated the Board concerning 12 Calvin Street. The owner filed a police report that some furniture had been stolen from the property. It is unclear what furniture that may have been. Photos of the property have been supplied to the Police and Aftermath, the cleaning company, will supply additional photographs to satisfy the Police request. It appears that a permanent residence has been setup for the owner. Several of the windows have been boarded up and ultimately the door will be boarded up. Mosquito Control Update — Cody advised the Board that typically this time of year, the catch basins have been treated with lavarcide but due to a change in the license requirement for the applicators requiring that they need to be full applicators license. The new requirement has hastened the process. As a result, a free seminar open to the public to provide health education information about disease prevention from mosquitoes and ticks will be held on Thursday, July 29, 2010. 60 Hartwell Avenue —Cody informed the Board of the interest to expand the composting operations at the 60 Hartwell Avenue facility to include a 4 -5 acre enclosed facility (which would be managed by a private corporation) to generate electricity from the methane captured during the composting process. It would be the first facility of its kind in Massachusetts. The Board of Health will be involved with all aspects of the planning process, including the BID process. The Board reviewed the minutes of June 9, 2010. Perlmutter motioned to accept the minutes as written. Geller seconded. All approved. The Board reviewed the Community Health Report. The Board reviewed the Standard Operating Procedure for Communicable Disease Follow -up. After a discussion, some clarifications are required. Heiger- Bernays motioned to adjourn.
