Minutes of the Lexington Zoning Board of Appeals

Petition Address: 200 Patriot Way, Map 18, Lot 15F
Prior to the hearing, the petition and supporting data were reviewed by the Building
Commissioner, Conservation Administrator, Town Engineer, Health Director, Board of
Selectmen, the Zoning Administrator, the Planning Administrator and Historic Districts
Commission Clerk. Comments were received from the Building Commissioner, the
Conservation Administrator, Health Director, Selectmen’s Office, Historic District
Commission and the Zoning Administrator.
The Chairman opened the hearing at 7:30 pm by reading the legal notice and described
information received from the petitioner relative to the petition. Mr. Barnert explained
the history of the 2004 plan that was approved by the Lexington Town Meeting. At this
time the applicant is before the Board to present plans for the proposed Building 200
which had been approved as part of the amended PSDUP. Neither the amended DSDUP
nor findings of fact have been submitted as required pursuant to the CD rezoning and
SPS zoning bylaw provision. The application for this hearing was not complete.
Attorney Robert Buckley presented the petition for the applicant, Shire HGT, Inc. Also
present was Jim Winiarski of Shire Pharmaceuticals, Attorney Peter Corbett of Goulston
& Storrs, John Hart, Civil Engineer with Symes Maini & McKee Associates, and Michael
Giardina Design Principal with Kling-Stubbins.
Attorney Buckley explained the development of the project. They filed new plans for the
200 building and had requested this hearing with the hope that they would be able to give
an overview of the project and to gather public input. They are planning on filing the
amended DSUP within the next two weeks.
They had a hearing scheduled with the Design Advisory Committee in the next week and
do not need any new plans or filings for Conservation.
John Hart the Civil Engineer for the project walked the Board thru the site plan for the
200 Building. Michael Giardina, the Design Principal, spoke of the design aspects of the
project.
Attorney Buckley stated there were a number of issues such as noise, reflection and the
landscaping that still need addressing

The Board asked about the traffic on the loop and commented that there had been no
discussion of the signs. The Board member had a minor concern with the look of the
parking lot coming in from the west. They discussed landscaping.
A Board member asked why Lincoln Street and Marrett Road hadn’t been included in the
traffic study and another asked what the population of employees was expected to be.
Attorney Buckley responded 400.
Richard Canale of 29 Shade Street commended the applicant on meeting with the
neighbors for their input. Mr. Canale wanted to let the applicant know the abutters had
concerns with the interior and exterior lighting, how the noise levels would be measured
and implementations for the additional traffic on Shade Street.
There were no further questions from the audience.
After further discussion on the noise issues the Board and the applicant agreed to
continue the hearing until March 11, 2010.
On a motion by Carolyn C. Wilson and seconded by Martha C. Wood, the Board voted 5-
0 to continue the hearing until Thursday, March 11, 2010.
