Geller, Sharon MacKenzie Health Department Attendees: Gerard F. Cody, Health Director; Ann Belliveau, Health Clerk Heiger-Bernays called to order at 7:00 p.m. The Board reviewed the minutes of April 14, 2010. Perlmutter motioned to accept the minutes as written. MacKenzie seconded. All approved. Cody introduced Larry Ramdin current President of MEHA and the Health Director at the Town of Reading to the Board. Ramdin presented Cody with the President’s Award for his support and had also been selected to receive Robert F. Periello Award for Excellence in the field of Environmental Health for 2010. He also has been selected as the sanitarian of the year. Ramdin also mentioned that Cody is the MEHA president elect of effective July 1, 2010. Community Health Report – The Board reviewed the Community Health Report and all follow-ups had been done in a timely manner. Environmental Health Report Cody informed the Board that testing at the Old Res will begin a few weeks before the opening to the public on June 5, 2010. The Board reviewed the food inspection report. Changhai – After a discussion, Perlmutter motioned that the consultant should continue for one more month and then report back to the Board of Health. MacKenzie seconded. All approved. Formosa Taipei – Cody advised the Board that Formosa Taipei opened in February 2010, and then at a routine inspection on April 28, 2010, Kathy Fox, Health Agent observed 8 critical and 8 non critical food code violations. At an Administrative meeting with the Health Director on May 3, 2010, the owner of Formosa Taipei agreed to the following corrective actions: 1)The owner of Formosa Taipei must hire a food consultant to conduct 3 random and unannounced State Santitary Code food inspections between May 15, 2010 and August 15 2010. 2)The food consultant must review the file folder with the Health Director or Health Agent before the first inspection. 3)The food consultant must be hired on or before May 15, 2010 and the signed contract must be submitted to the Health Department. 4)The owner of Formosa Taipei must ensure that all staff complete the PIC training held by the Health Dept. 5)The consultant must establish a cleaning schedule for Formosa Taipei 6)The owner of Formosa Taipei must appear before the Board of Health at regularly scheduled meetings from May through September 2010 to provide updates. Mr. Lee informed the Board that a contract has been signed with Formosa Taipei for three months and three unannounced inspections will take place followed with a report. MacKenzie motioned that due to the number of critical violations and repeat violations, the Lexington Board of Health is in agreement with the corrective action plan as outlined at the Administrative meeting on May 3, 2010. Perlmutter seconded. All approved. The Board reviewed the food inspection report. Cody advised the Board that Teppanyaki has been sold and it was purchased by a former employee of Teppanyaki. The new establishment will be called RUYI Bar and Grill. Cody mentioned that a food training course was conducted on May 5, 2010, with about 30 participants from 12 establishments. Housing Updates 12 Calvin Street – Cody advised the Board that the building at 12 Calvin Street is almost cleared out. Seven roll offs were used to clean out the premises. The basement and first floor have been boarded up. 16 Estabrook Road – Cody updated the Board concerning progress being made at 16 Estabrook Road. To date, Servepro has used 4 roll offs to remove debris from the basement. The owner of the property has been in touch with DPW and it appears there is a spring under the house so a determination will need to be made concerning the discharge of water from a sump dump. 2521 Mass Avenue – Cody informed the Board that a letter was sent to the owners and they complied within 21 days 18 Tarbell Avenue - Cody received a request for a housing inspection from the tenants at 18 Tarbell Avenue. The inspection indicated a possible hoarding, some issues with the foundation, the oil tank is somewhat compromised. The Building Dept. and the Fire Dept. are also involved with this property. Pool Variance Requests – Cody advised the Board that the following pools have requested relief in the form of a variance from 105 CMR 435.23 (1) Lifeguards: Brookhaven at Lexington Moon Hill Community School Drummer Boy Green Condo Peacock Farm Adams Pool Five Field Pool Pleasant Brook Pool Assoc. Avalon at Lexington Hills, Main Campus Avalon at Lexington, Lex. Ridge Dr. Heiger-Bernays motioned that the Lexington board of Health grants the variance request from the requirement of lifeguards for the safe operation of pools as listed under 105 CMR 435.23 (1). In addition, all the requirements of 105 CMR 435.23 (2) shall be met including all signage which includes: “Warning No Lifeguard on Duty” in easy to read, legible letters which are at least four inches high “Children under age of 16 should not use swimming pool without an adult in attendance” and another sign that states, “Adults should not swim alone”. This variance only applies to the above referenced season pool facilities, which have made the request in writing. This variance will expire at the end of the seasonal pool season or upon notification of an unsafe operating condition at a specific facility. MacKenzie seconded. All approved. th Emergency Preparedness Updates - Cody stated that on May 13 he received a new EDS plan from Region 4a which is more of a technical document instead of the current operations plan for emergency dispensing. The new EDS plan meets all of the TAR requirements. Also, on June 9 the Region is having a table top exercise to become more familiar with the EDS plan. Heiger-Bernays began a discussion concerning the PCB testing in the schools and municipal bldg. Heiger-Bernays said that the data received from the testing was not good enough to draw a conclusion in that the testing done for the presence of PCB’s in the air was not done correctly and that the method being used didn’t allow a conclusion to be drawn about what the levels might be in air. Cody then forwarded the samples to the State Dept. of Public Health and they came to the same conclusion. As a result, the next step is to go back and resample the indoors. Since there are only a few labs and a few consultants who can do this because PCBs are extremely complex and depending upon what analysis used and the duration of the test it can become very costly. Also, from a health issue, all of the caulk is on the outside. Heiger-Bernays would like to have an open meeting with the schools, parents, DPH and EPA to answer questions. MacKenzie motioned to adjourn. Perlmutter seconded. All approved.
