Lexington Board of Health Meeting, March 10, 2010 at 7:00 p.m.

Heiger-Bernays called to order at 7:00 p.m.
The Board reviewed the minutes of December 9, 2009. Perlmutter motioned to accept
the minutes with corrections. MacKenzie seconded. All approved.
Community Health Report – Cody asked Namrata Singh, Public Health Intern, to present
the report to the Board. Singh advised the Board that she and Neylon, visited and
administered H1N1 vaccines to the Lexington Playcare Center, The Jewish Preschool of
Lexington, the LEAP School and plan to vaccinate at the First Circle Learning Center.

Singh also mentioned that on March 312010, there will be the Fasting Blood Glucose
Test and Diabetes Presentation at the Senior Center. Singh also advised the Board of an
upcoming Shingles Clinic to be held in April at the Senior Center with a limited number
of State supplied vaccines. Singh is also working on the after action report to be held on
4/6/10 to thank the MRC volunteers and to get an after action report and best practices
discussion.
The Board reviewed the Community Health Report and all follow-ups had been done in a
timely manner.
Environmental Health Report
Khushboo - Cody informed the Board that Kushboo’s Food Safety Consultant, Lisa M.
Berger, was unable to attend the meeting this evening, but in her opinion, she feels that
they have met the requirements of the order dated November 2009. Cody went to the
establishment prior to the meeting and found the establishment much improved.
Perlmutter motioned that the Lexington Board of Health considers that Kushboo has
completed all the requirements of the Order Letter dated 11/16/2009. Further
Administrative action, including suspension and fines will be imposed should similar or
repeat food code violations as noted in earlier reports continue to be observed at future
inspections. MacKenzie seconded. All approved.
Changhai - Cody advised the Board that during a food inspection in December 2009,
Health Agent Kathy Fox found 8 critical and 16 non critical food violations. Previous
inspection reports from last spring only reported 3 critical violations. Due to the sharp
increase and the number of repeat violations, the owner of Changhai, Jason Quan was
required to meet with the Health Director for an Administrative meeting. At the
conclusion of this Administrative meeting, the owner of Changhai has agreed to hire a
food consultant to conduct three (3) random and unannounced State Sanitary Code
compliance food inspections between January 1, 2010 and May 1, 2010. Maureen Lee,
food consultant for Changhai updated the Board concerning recent training and
inspections. The Board continued Changhai until next month.
Training Dates – Cody mentioned that Pilgrim Hospitality has been hired to conduct food
training for the Spanish-speaking food worker.
New Estabishments – Plan Review
Formosa Taipei – Cody introduced Mr. Steve Cao, owner of Formosa Taipei. Mr.
Cao had submitted a food plan review for this new establishment which met all of the
Food State Sanitary Code. After a discussion, Perlmutter motioned that the Lexington
Board of Health grants an annual permit to operate a food establishment to Formosa
Taipei at 315 Marrett Road. MacKenzie seconded. All approved.
Housing Updates
66 Simonds Road – Cody was notified by the Fire Department of a small house
fire at 66 Simonds Road which was being rented at the time. The tenant requested a
housing inspection which indicated violations of the housing code. The tenant stayed at a
hotel for 7-10 days and worked it out with the landlord to move elsewhere. The owner
corrected all of the violations and a closure letter was sent to him.
119 Emerson Gardens – Cody received a call from the Lexington Police because
this residence was in deplorable condition. The woman is an 84 year-old and has now
returned home after spending 3 weeks at a local rehabilitation center. Public Health
nurse will continue to monitor.
Environmental Health Report
The Board reviewed the Environmental Health Report. Heiger-Bernays asked
that the report be in a format similar to the Community Health Report.
Heiger-Bernays began a discussion because there are two pieces about the PCB
issue at Estabrook and they were both triggered by the lack of information about the
testing and the validity of the data. Heiger-Bernays said the State has been contacted and
Heiger-Bernays still has not received data. Cody recommends retesting. Heiger-Bernays
wants to make sure that Pat Goddard, Facililties Director, works with Cody to make sure
the lab performing the test is able to conduct the analysis and work with the State. A
discussion followed.
MacKenzie motioned to adjourn. Geller seconded. All approved.
